Amend House Bill 2909, AS AMENDED, 3 in Section 5, Sec. 4.1, subsection (a), the sentence 4 beginning "Upon any retail", by deleting "of the methanol 5 derivative methyl tertiary butyl ether (MTBE),"; and 6 in Section 5, Sec. 4.1, subsection (a), the sentence 7 beginning "Upon any retail", by deleting "of the methanol 8 derivative MTBE,"; and 9 in Section 5, Sec. 4.1, subsection (a), by deleting the 10 sentence beginning "With respect to the methanol derivative 11 MTBE,"; and 12 in Section 5, Sec. 4.1, subsection (a), the sentence 13 beginning "Devices used to dispense", by replacing "methanol, 14andethanol, and the methanol derivative MTBE" with "methanol 15 and ethanol"; and 16 in Section 5, Sec. 4.1, immediately below subsection (a), by 17 inserting the following: 18 "(a-5) Upon any retail motor fuel dispensing device that 19 is used to dispense a motor fuel containing at least 2% by 20 volume of the methanol derivative methyl tertiary butyl ether 21 (MTBE), there shall be displayed a label stating: "CONTAINS 22 METHYL TERTIARY BUTYL ETHER (MTBE)". The label shall be done -2- LRB9107923ACtmam 1 in contrasting colors with block letters at least 1/2 inch in 2 height and 1/4 inch in width, and not more than one inch in 3 height and 1/2 inch in width, and shall be visible to 4 customers. The label shall be located on the front or sides 5 of the dispenser and within the top 30 percent of the height 6 of the dispenser. On a dual-faced dispenser, the label shall 7 be affixed on each front or each side in accordance with 8 these requirements. Devices used to dispense only motor 9 fuels that contain a total of less than 2% by volume of the 10 methanol derivative MTBE need not be so labeled."; and 11 in Section 5, Sec. 4.1, immediately below subsection (e), by 12 inserting the following: 13 "(f) Nothing in this Section shall be construed to 14 require or impose an obligation upon the owner or operator of 15 a retail motor fuel dispensing station, facility, or device 16 to perform a test on or measurement of a shipment of motor 17 fuel received to determine the specific content of ethanol, 18 methanol, or the methanol derivative MTBE.".
