Amend House Bill 2085, AS AMENDED, 3 by replacing the title with the following: 4 "AN ACT to amend the Illinois Vehicle Code by changing 5 Sections 12-205.1 and 12-709."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Illinois Vehicle Code is amended by 9 changing Sections 12-205.1 and 12-709 as follows: 10 (625 ILCS 5/12-205.1) (from Ch. 95 1/2, par. 12-205.1) 11 Sec. 12-205.1. Implements of husbandry or slow-moving 12 vehicles-Display of amber signal lamp. Every animal drawn 13 vehicle, farm tractor, implement of husbandry and special 14 mobile equipment, except when used for road construction or 15 maintenance within the limits of a construction or 16 maintenance project where traffic control devices are used in 17 compliance with the applicable provisions of the manual and 18 specifications adopted under Section 11-301 of the Illinois 19 Vehicle Code, when operated on a highway during a time when 20 lighted lamps are required by Section 12-201 of this Chapter, 21 shall display to the rear at least one flashing amber signal -2- LRB9102573KSgcam01 1 lamp mounted as high as practicable and of sufficient 2 intensity to be visible for a distance of at least 500 feet 3 in normal sunlight; provided, that only the rearmost vehicle 4 of a combination of vehicles coupled together need display 5 such lamp. The flashing amber signal lamp may be operated 6 lighted during daylight hours when other lamps are not 7 required to be lighted when vehicles authorized in this 8 Section are operated on a highway. Implements of husbandry 9 manufactured on or after January 1, 2003 and operated on 10 public roads between sunset and sunrise shall display 11 markings and lighting that meet or exceed the design, 12 performance, and mounting specifications adopted by the 13 American Society of Agricultural Engineers and published by 14 that body as ASAE S 279.10 APR98. 15 (Source: P.A. 84-285.) 16 (625 ILCS 5/12-709) (from Ch. 95 1/2, par. 12-709) 17 Sec. 12-709. Slow-moving vehicle emblem. 18 (a) Every animal drawn vehicle, farm tractor, implement 19 of husbandry and special mobile equipment, when operated on a 20 highway must display a slow-moving vehicle emblem mounted on 21 the rear except as provided in paragraph (b) of this Section. 22 Special mobile equipment is exempt when operated within the 23 limits of a construction or maintenance project where traffic 24 control devices are used in compliance with the applicable 25 provisions of the manual and specifications adopted under 26 Section 11-301 of the "Illinois Vehicle Code". 27 (b) Every vehicle or unit described in paragraph (a) of 28 this Section when operated in combination on a highway must 29 display a slow-moving vehicle emblem as follows: 30 1. Where the towed unit or any load thereon 31 partially or totally obscures the slow-moving vehicle 32 emblem on the towing unit, the towed unit shall be 33 equipped with a slow-moving vehicle emblem. In such cases -3- LRB9102573KSgcam01 1 the towing unit need not display the emblem. 2 2. Where the slow-moving vehicle emblem on the 3 towing unit is not obscured by the towed unit or its 4 load, then either or both may be equipped with the 5 required emblem but it shall be sufficient if either 6 displays it. 7 3. A registered truck towed behind a farm tractor 8 in conformity with the provisions of Section 11-1418 of 9 the "Illinois Vehicle Code" must display a slow-moving 10 vehicle emblem in the manner provided in paragraph (c) 11 while being towed on a highway if the emblem on the 12 towing vehicle is partially or totally obscured. 13 (c) The slow-moving vehicle emblem required by 14 paragraphs (a) and (b) of this Section must meet the 15 specifications and mounting requirements established by the 16 Department. Such specifications and mounting requirements 17 shall be based on the specifications adopted by the American 18 Society of Agricultural Engineers and published by that body 19 as ASAE S 276.2 dated March, 1968 or as ASAE S 276.5. No 20 advertising or other marking shall appear upon the emblem 21 except that specified by the American Society of Agricultural 22 Engineers to identify the standard to which the material 23 complies. Each original package containing a slow-moving 24 vehicle emblem shall display a notice on the outside of the 25 package stating that such emblem shall only be used for the 26 purposes stated in subsections (a) and (b). 27 (d) A slow-moving vehicle emblem is intended as a safety 28 identification device and shall not be displayed on any 29 vehicle nor displayed in any manner other than as described 30 in paragraphs (a), (b) and (c) of this Section. 31 (Source: P.A. 86-1259.)".
