91_HB1863 LRB9105186RCdv 1 AN ACT to amend the Unified Code of Corrections by 2 changing Section 3-7-7. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unified Code of Corrections is amended by 6 changing Section 3-7-7 as follows: 7 (730 ILCS 5/3-7-7) (from Ch. 38, par. 1003-7-7) 8 Sec. 3-7-7. The Department shall establish rules 9 governing the provision of mental health services to 10 committed persons. Such rules shall provide, among other 11 matters, that a committed person who is diagnosed as 12 suffering from a mental illness or developmental disability 13 shall have access to treatment as determined necessary by a 14 qualified mental health or developmental disability 15 professional of the Department, and that mental health 16 records be disclosed only for purposes authorized by 17 Department rule or the Unified Code of Corrections or as 18 otherwise authorized by law. A committed person in a maximum 19 security facility of the Department who is receiving mental 20 health services may be handcuffed. 21 (Source: P.A. 86-1403.)
