Amend House Bill 1280 by replacing 3 the title with the following: 4 "AN ACT to amend the Mental Health and Developmental 5 Disabilities Code by adding Section 2-110.5."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Mental Health and Developmental 9 Disabilities Code is amended by adding Section 2-110.5 as 10 follows: 11 (405 ILCS 5/2-110.5 new) 12 Sec. 2-110.5. Electro-convulsive therapy for minors. If 13 a recipient is a minor, that recipient's parent or guardian 14 is authorized, only with the approval of the court under the 15 procedures set out in Section 2-107.1, to provide consent for 16 participation of the minor in electro-convulsive therapy if 17 the parent or guardian deems it to be in the best interest of 18 the minor. In addition to the requirements in Section 19 2-107.1, prior to the court entering an order approving 20 treatment by electro-convulsive therapy, 2 licensed 21 psychiatrists, one of which may be the minor's treating -2- LRB9103956SMdvam02 1 psychiatrist, who have examined the patient must concur in 2 the determination that the minor should participate in 3 treatment by electro-convulsive therapy. 4 Section 99. Effective date. This Act takes effect upon 5 becoming law.".
