Amend House Bill 809, AS AMENDED, by 3 replacing the title with the following: 4 "AN ACT to amend the Illinois Vehicle Code by changing 5 Section 12-815."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Illinois Vehicle Code is amended by 9 changing Section 12-815 as follows: 10 (625 ILCS 5/12-815) (from Ch. 95 1/2, par. 12-815) 11 Sec. 12-815. Strobe lamp on school bus. 12 (a) A school bus manufacturedpurchasedprior to January 13 1, 2000the effective date of this amendatory Act of the 91st14General Assemblymay be equipped with one strobe lamp that 15 will emit 60 to 120 flashes per minute of white or 16 bluish-white light visible to a motorist approaching the bus 17 from any direction. A school bus manufacturedpurchasedon or 18 after January 1, 2000the effective date of this amendatory19Act of the 91st General Assemblyshall be equipped with one 20 strobe lamp that will emit 60 to 120 flashes per minute of 21 white or bluish-white light visible to a motorist approaching -2- LRB9103411DHpkam05 1 the bus from any direction. The lamp shall be of sufficient 2 brightness to be visible in normal sunlight when viewed 3 directly from a distance of at least one mile. 4 (b) The strobe lamp shall be mounted on the rooftop of 5 the bus with the light generating element in the lamp located 6 equidistant from each side and either at or behind the center 7 of the rooftop. The maximum height of the element above the 8 rooftop shall not exceed 1/30 of its distance from the rear 9 of the rooftop. If the structure of the strobe lamp obscures 10 the light generating element, the element shall be deemed to 11 be in the center of the lamp with a maximum height 1/4 inch 12 less than the maximum height of the strobe lamp unless 13 otherwise indicated in rules and regulations promulgated by 14 the Department. The Department may promulgate rules and 15 regulations to govern measurements, glare, effectiveness and 16 protection of strobe lamps on school buses, including higher 17 strobe lamps than authorized in this paragraph. 18 (c) The strobe lamp may be lighted only when the school 19 bus is actually being used as a school bus and: 20 1. is stopping or stopped for loading or 21 discharging pupils on a highway outside an urban area; or 22 2. is bearing one or more pupils and is either 23 stopped or, in the interest of safety, is moving very 24 slowly at a speed: 25 (i) less than the posted minimum speed limit, 26 or 27 (ii) less than 30 miles per hour on a highway 28 outside an urban area. 29 (Source: P.A. 91-168, eff. 1-1-00.) 30 Section 95. No acceleration or delay. Where this Act 31 makes changes in a "statute that is represented in this Act 32 by text that is not yet or no longer in effect (for example, 33 a Section represented by multiple versions), the use of that -3- LRB9103411DHpkam05 1 text does not accelerate or delay the taking effect of (i) 2 the changes made by this Act or (ii) provisions derived from 3 any other Public Act. 4 Section 99. Effective date. This Act takes effect upon 5 becoming law.".
