91_HB0809enr HB0809 Enrolled LRB9103411KSgc 1 AN ACT concerning vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 2. The State Finance Act is amended by changing 5 Section 6z-23 as follows: 6 (30 ILCS 105/6z-23) (from Ch. 127, par. 142z-23) 7 Sec. 6z-23. All monies received by the Secretary of 8 State pursuant to paragraph (f) of Section 2-119 of the 9 Illinois Vehicle Code shall be deposited in the 10 CDLIS/AAMVAnet Trust Fund. The money in this Fund shall only 11 be used by the Secretary of State to pay for (1) the 12 enrollment of commercial drivers into the Commercial Driver 13 License Information System (CDLIS), (2) network charges 14 assessed Illinois by AAMVAnet, Inc., for motor vehicle and 15 driver records data and information, and (3) expenses 16 (limited to equipment, maintenance, and software) related to 17 the testing of applicants for commercial driver's licenses 18equipment to be used for the testing of applicants for19commercial driver's licenses and the maintenance of that20equipment. 21 (Source: P.A. 91-537, eff. 8-13-99.) 22 Section 5. The Illinois Vehicle Code is amended by 23 changing Sections 3-626 and 12-815 as follows: 24 (625 ILCS 5/3-626) 25 Sec. 3-626. Korean War Veteran license plates. 26 (a) In addition to any other special license plate, the 27 Secretary, upon receipt of all applicable fees and 28 applications made in the form prescribed by the Secretary of 29 State, may issue special registration plates designated as HB0809 Enrolled -2- LRB9103411KSgc 1 Korean War Veteran license plates to residents of Illinois 2 who participated in the United States Armed Forces during the 3 Korean War. The special plate issued under this Section 4 shall be affixed only to passenger vehicles of the first 5 division, motor vehicles of the second division weighing not 6 more than 8,000 pounds, and recreational vehicles as defined 7 by Section 1-169 of this Code. Plates issued under this 8 Section shall expire according to the staggered multi-year 9 procedure established by Section 3-414.1 of this Code. 10 (b) The design, color, and format of the plates shall be 11 wholly within the discretion of the Secretary of State. The 12 Secretary may, in his or her discretion, allow the plates to 13 be issued as vanity plates or personalized in accordance with 14 Section 3-405.1 of this Code. The plates are not required to 15 designate "Land Of Lincoln", as prescribed in subsection (b) 16 of Section 3-412 of this Code. The Secretary shall prescribe 17 the eligibility requirements and, in his or her discretion, 18 shall approve and prescribe stickers or decals as provided 19 under Section 3-412. 20 (c) An applicant shall be charged a $15 fee for original 21 issuance in addition to the applicable registration fee. Of 22 this additional fee, $13 shall be deposited into the 23 Secretary of State Special License Plate Fund and $2 shall be 24 deposited into the Korean War Memorial Construction Fund. 25 For each registration renewal period, a $2 fee, in addition 26 to the appropriate registration fee, shall be charged and 27 shall be deposited into the Secretary of State Special 28 License Plate Fund. 29 (d) The Korean War Memorial Construction Fund is created 30 as a special fund in the State treasury. All moneys in the 31 Korean War Memorial Construction Fund shall, subject to 32 appropriation, be used by the Department of Veteran Affairs 33 to provide grants for construction of the Korean War Memorial 34 to be located at Oak Ridge Cemetery in Springfield, Illinois. HB0809 Enrolled -3- LRB9103411KSgc 1 Upon the completion of the Memorial, the Department of 2 Veteran Affairs shall certify to the State Treasurer that the 3 construction of the Memorial has been completed. Upon the 4 certification by the Department of Veteran Affairs, the State 5 Treasurer shall transfer all moneys in the Fund and any 6 future deposits into the Fund into the Secretary of State 7 Special License Plate Fund. 8 (e) An individual who has been issued Korean War Veteran 9 license plates for a vehicle and who has claimed and received 10 a grant under the Senior Citizens and Disabled Persons 11 Property Tax Relief and Pharmaceutical Assistance Act shall 12 pay50% ofthe original issuance and the regular annual fee 13 for the registration of the vehicle as provided in Section 14 3-806.3 of this Code in addition to the fees specified in 15 subsection (c) of this Section.The 50% reduction shall not16apply to the additional fee for the original issuance or the17additional fee for each renewal under subsection (c).18 (Source: P.A. 88-485; 88-560, eff. 8-4-94; 88-670, eff. 19 12-2-94; 89-98, eff. 1-1-96; 89-282, eff. 8-10-95; 89-626, 20 eff. 8-9-96.) 21 (625 ILCS 5/12-815) (from Ch. 95 1/2, par. 12-815) 22 Sec. 12-815. Strobe lamp on school bus. 23 (a) A school bus manufacturedpurchasedprior to January 24 1, 2000the effective date of this amendatory Act of the 91st25General Assemblymay be equipped with one strobe lamp that 26 will emit 60 to 120 flashes per minute of white or 27 bluish-white light visible to a motorist approaching the bus 28 from any direction. A school bus manufacturedpurchasedon or 29 after January 1, 2000the effective date of this amendatory30Act of the 91st General Assemblyshall be equipped with one 31 strobe lamp that will emit 60 to 120 flashes per minute of 32 white or bluish-white light visible to a motorist approaching 33 the bus from any direction. The lamp shall be of sufficient HB0809 Enrolled -4- LRB9103411KSgc 1 brightness to be visible in normal sunlight when viewed 2 directly from a distance of at least one mile. 3 (b) The strobe lamp shall be mounted on the rooftop of 4 the bus with the light generating element in the lamp located 5 equidistant from each side and either at or behind the center 6 of the rooftop. The maximum height of the element above the 7 rooftop shall not exceed 1/30 of its distance from the rear 8 of the rooftop. If the structure of the strobe lamp obscures 9 the light generating element, the element shall be deemed to 10 be in the center of the lamp with a maximum height 1/4 inch 11 less than the maximum height of the strobe lamp unless 12 otherwise indicated in rules and regulations promulgated by 13 the Department. The Department may promulgate rules and 14 regulations to govern measurements, glare, effectiveness and 15 protection of strobe lamps on school buses, including higher 16 strobe lamps than authorized in this paragraph. 17 (c) The strobe lamp may be lighted only when the school 18 bus is actually being used as a school bus and: 19 1. is stopping or stopped for loading or 20 discharging pupils on a highway outside an urban area; or 21 2. is bearing one or more pupils and is either 22 stopped or, in the interest of safety, is moving very 23 slowly at a speed: 24 (i) less than the posted minimum speed limit, 25 or 26 (ii) less than 30 miles per hour on a highway 27 outside an urban area. 28 (Source: P.A. 91-168, eff. 1-1-00.) 29 Section 95. No acceleration or delay. Where this Act 30 makes changes in a "statute that is represented in this Act 31 by text that is not yet or no longer in effect (for example, 32 a Section represented by multiple versions), the use of that 33 text does not accelerate or delay the taking effect of (i) HB0809 Enrolled -5- LRB9103411KSgc 1 the changes made by this Act or (ii) provisions derived from 2 any other Public Act. 3 Section 99. Effective date. This Act takes effect upon 4 becoming law.
