91_HB0130eng HB0130 Engrossed LRB9100818KSgc 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Section 11-1414.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Section 11-1414.1 as follows: 7 (625 ILCS 5/11-1414.1) (from Ch. 95 1/2, par. 11-1414.1) 8 Sec. 11-1414.1. School transportation of students. 9 (a) Every student enrolled in grade 12 or below in any 10 entity listed in paragraph (a) of Section 1-182 of this Code 11 who is transported in a second division motor vehicle owned 12 or operated by or for that entity, in connection with any 13 official activity of such entity, must be transported in a 14 school bus or a bus described in subparagraph (1) of 15 paragraph (b) of Section 1-182. 16 (b) This Section shall not apply to any second division 17 vehicle being used by such entity in a parade, homecoming or 18 similar school activity, or, if authorized by the school 19 board and supervised by the school district, an agrarian 20 related school activity, nor to a motor vehicle designed for 21 the transportation of not less than 7 nor more than 16 22 persons while that vehicle is being operated by or for a 23 public or private primary or secondary school, including any 24 primary or secondary school operated by a religious 25 institution, for the purpose of transporting not more than 15 26 students to and from interscholastic athletic or other 27 interscholastic or school sponsored activities. A school 28 board that authorizes a second division vehicle to transport 29 students enrolled in grade 12 or below for an agrarian 30 related school activity shall accept liability for any injury 31 or damage resulting from the transportation of the students.
