Amend Senate Bill 827, on page 1, by 3 replacing lines 9 through 30 with the following: 4 "(a) Whoever: 5 (1) knowingly enters or remains within a building 6 not used as a residence, other than a building open to 7 the public during normal hours of operation, without 8 lawful authority; or 9 (2) enters upon the land of another, after 10 receiving, prior to such entry, notice from the owner or 11 occupant that such entry is forbidden; or 12 (3) remains upon the land of another, after 13 receiving notice from the owner or occupant to depart; or 14 (4) enters upon one of the following areas in or on 15 a motor vehicle (including an off-road vehicle, 16 motorcycle, moped, or any other powered two-wheel 17 vehicle), after receiving prior to that entry, notice 18 from the owner or occupant that the entry is forbidden or 19 remains upon or in the area after receiving notice from 20 the owner or occupant to depart: 21 (A) any field that is used for growing crops 22 or which is capable of being used for growing crops; 23 or 24 (B) an enclosed area containing livestock; or -2- SRS90SB0827MJsaam01 1 (C) or an orchard; or 2 (D) a barn or other agricultural building 3 containing livestock; 4 commits a Class B misdemeanor. 5(a) Whoever enters upon the land or a building, other6than a residence, or any part thereof of another, after7receiving, prior to such entry, notice from the owner or8occupant that such entry is forbidden, or remains upon the9land or in a building, other than a residence, of another10after receiving notice from the owner or occupant to depart,11commits a Class B misdemeanor. A person who violates this12subsection (a) by entering upon one of the following areas,13in or on a motor vehicle (including an off-road vehicle,14motorcycle, moped, or any other powered two-wheel vehicle),15after receiving prior to that entry, notice from the owner or16occupant that the entry is forbidden or remains upon or in17the area after receiving notice from the owner or occupant to18depart commits a Class B misdemeanor:19(1) any field that is used for growing crops or20which is capable of being used for growing crops;21(2) an enclosed area containing livestock;22(3) an orchard; or23(4) a barn or other agricultural building24containing livestock.".
