Short description: 
CRIM CD-TRESPASS TO REAL PROP                                              

Synopsis of Bill as introduced:
        Amends the Criminal Code of 1961.  Provides that  whoever  enters      
   or  remains  within a building, other than a residence, without lawful      
   authority (now, enters after receiving notice that entry is  forbidden      
   or  remains  after  receiving notice to depart) is guilty of a Class B      
   misdemeanor.  Effective immediately.                                        
        SENATE AMENDMENT NO. 1.                                                
        Deletes all changes made by the bill. Provides that whoever en-        
   ters or remains within a building not used as a residence, enters upon      
   the land of another after receiving prior notice that entry is for-         
   bidden, remains upon the land of another after receiving notice to          
   depart, enters certain areas in or on a motor vehicle after receiving       
   prior notice that entry is forbidden, or remains on the land after          
   receiving notice to depart is guilty of criminal trespass to real pro-      
   perty, a Class B misdemeanor.                                               
        SENATE AMENDMENT NO. 2.                                                
        Provides that whoever  knowingly  and  without  lawful  authority      
   enters  or  remains  within a building, other than a building which is      
   open to the public during its normal hours  of  operation,  commits  a      
   Class B misdemeanor.  Deletes provision stating that the building must      
   not be used as a residence.                                                 
          CORRECTIONAL NOTE                                                    
          SB827 would have no population or fiscal impact on this Dept.        
        HOUSE AMENDMENT NO. 1.                                                 
        Provides that knowingly remaining in a  building  without  lawful      
   authority  is  criminal  trespass to real property.  Provides that the      
   prohibition on knowingly and  without  lawful  authority  entering  or      
   remaining within a building does not apply to being in a building that      
   is  open to the public while the building is so open during its normal      
   hours of operation; nor does  the  prohibition  apply  to  entering  a      
   public  building  under  reasonable  belief that the building is still      
   open to the public.  Provides that the offense of criminal trespass to      
   real property does not apply to entering a building or open  land  for      
   emergency purposes.
