The Criminal Code of 1961 is amended by 6 changing Section 3-3 as follows: 7 (720 ILCS 5/3-3) (from Ch. 38, par. 3-3) 8 Sec. 3-3. Multiple prosecutions for same act. 9 (a) When the same conduct of a defendant may establish 10 the commission of more than one offense, the defendant may be 11 prosecuted for eachsuchoffense. 12 (b) If the several offenses are known to the proper 13 prosecuting officer at the time of commencing the prosecution 14 and are within the jurisdiction of a single court, they must 15 be prosecuted in a single prosecution, except as provided in 16 Subsection (c), if they are based on the same act. 17 (c) When 2 or more offenses are charged as required by 18 Subsection (b), the court in the interest of justice may 19 order that one or more of thesuchcharges shall be tried 20 separately. 21 (Source: Laws 1961, p. 1983.)
