Sec. 1.
Short title.
This Act may be cited as the MTBE Elimination Act.

Sec. 5.
Findings.
The General Assembly finds that methyl tertiary butyl
ether (MTBE) presents substantial environmental risks to the water quality in
Illinois, as well as to the public health, safety, and welfare of the people of
the State of Illinois.

Sec. 10.
Definitions.
As used in this Act:
"MTBE" means methyl tertiary butyl ether.
"Agency" means the Illinois Environmental Protection Agency.
"Trace amount" means an amount not exceeding 0.5% by volume of the motor
fuel.

Sec. 15.
MTBE Prohibitions.
Beginning 3 years after the effective date
of this Act, no person shall use, sell, offer for sale, distribute, blend, or
manufacture MTBE as a fuel additive in Illinois. It is not a violation
of this Act for a person to sell, offer for sale, distribute, or blend a motor
fuel in
Illinois containing a trace amount of MTBE.

Sec. 20.
Programs.
The Agency is hereby directed to coordinate with the
United States Environmental Protection Agency, other federal, state, and local
governmental agencies, and private entities to develop accurate and improved
MTBE groundwater testing methodologies and to develop more efficient and cost
effective remediation procedures for public water supplies and sources
contaminated with MTBE.
