    AN ACT concerning the environment.

    Be it enacted by the People of  the  State  of  Illinois,
represented in the General Assembly:

    Section  5.   The  MTBE  Elimination  Act  is  amended by
changing Sections 10 and 15 as follows:

    (415 ILCS 122/10)
    Sec. 10. Definitions.  As used in this Act:
    "MTBE" means methyl tertiary butyl ether.
    "Agency"  means  the  Illinois  Environmental  Protection
Agency.
    "Trace amount" means an  amount  not  exceeding  0.5%  by
volume of the motor fuel.

    (415 ILCS 122/15)
    Sec.  15. MTBE Prohibitions.  Beginning 3 years after the
effective date of this Act, no person shall use, sell,  offer
for  sale,  distribute,  blend, or manufacture MTBE as a fuel
additive in Illinois.  It is not a violation of this Act  for
a  person  to  sell,  offer  for sale, distribute, or blend a
motor fuel in Illinois containing a trace amount of MTBE.

    Section 99.  Effective date.  This Act takes effect  upon
becoming law.
    Passed in the General Assembly April 25, 2002.
    Approved June 24, 2002.
    Effective June 24, 2002.
