AN ACT in relation to certain land.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Article 5.
Section 5-5. Upon the payment of the sum of $15,000 to
the State of Illinois, and subject to the condition set forth
in Section 5-100 of this Act, the Secretary of Transportation
is authorized to convey by quitclaim deed all right, title,
and interest in and to the following described land in St.
Clair County, Illinois, to Aldi, Inc.:
Parcel No. 800XA91
Part of Lots 7 and 8 of Bellevue Addition to Swansea as
recorded in Book of Plats "G", Page 47 of the St. Clair
County Land Records, all located in the Southeast Quarter
of Section 16, Township 1 North, Range 8 West of the
Third Principal Meridian, St. Clair County, Illinois,
being more particularly described as follows:
Commencing at a found brass monument marking centerline
Station 117+82.26 of SBI Route 159; thence North 89
degrees 27 minutes 53 seconds West, 55.00 feet to a point
located on the west line of said SBI Route 159; thence
along a curve to the right, having a radius of 2,236.83
feet, an arc length of 21.22 feet and a chord bearing of
South 00 degrees 47 minutes 09 seconds West, 21.22 feet
to the Point of Beginning.
From said Point of Beginning; thence along a curve to the
right, having a radius of 2,236.83 feet, an arc length of
73.87 feet and a chord bearing of South 02 degrees 01
minute 45 seconds West, 73.87 feet to a point located on
the north line of Caroline Street; thence North 88
degrees 04 minutes 01 second West along said north line
of Caroline Street, 98.50 feet to a point on the west
line of said Lot 8; thence North 00 degrees 38 minutes 55
seconds East along said west line, 10.00 feet to a point;

Parcel 800XA91 herein described contains 0.095 acre.
Basis of bearing is based on the Illinois State Plane
Coordinate System, West Zone.
Section 5-10. Upon the payment of the sum of $4,000 to
the State of Illinois, and subject to the conditions set
forth in Section 5-100 of this Act, the easement for highway
purposes acquired by the People of the State of Illinois is
released over and through the following described land in
Peoria County, Illinois:

A part of Lot 1 of Johnson and Wead's Subdivision of the
Northwest Quarter of Section 29, Township 9 North, Range
8 East of the Fourth Principal Meridian, Peoria County,
State of Illinois, described in detail as follows.
Commencing at the center of said Section 29, thence North
0 Degrees 32 Minutes East (Bearings are assumed for
descriptive purposes only), 87.7 feet along the east line
of the Northwest Quarter of said Section 29 to a point on
the existing Survey Line of F.A. Route 31 at Station
246+38.6; thence northwesterly 931.3 feet along the
Survey Line to Station 237+07.3, said Survey Line being a
curve concave to the north, said curve having a radius of
4244.23 feet with a chord length of 929.4 feet bearing
North 70 Degrees 53 Minutes West; thence South 0 Degrees
31 Minutes West, 87.1 feet, more or less to a point
79.17 feet radially distant southwesterly from the said
Survey Line, said point also being the Point of
Beginning.

Section 5-15. Upon the payment of the sum of $9,400 to
the State of Illinois, the rights and easements of access,
crossing, light, air, and view from, to, and over the
following described line and FAP Route 322 are restored
subject to permit requirements of the State of Illinois,
Department of Transportation.

Direct access to FAP Route 322 (U.S. 51) shall be
restored to 467.93 feet of a tract of land abutting the
westerly right of way line of said highway from the
intersection of the north line of the Northeast Quarter
of the Southwest Quarter of Section 19, Township 1 North,
Range 1 East of the Third Principal Meridian and the
westerly right of way line of said FAP Route 322 at a
point 60.00 feet westerly of Station 839+53 of the
centerline of said FAP Route 322; thence southerly 467.93
feet along said right of way line, to a point 60.00 feet
westerly of Station 835+00.

Upon the payment of the sum of $900 to the State of
Illinois, and subject to the condition set forth in Section
5-100 of this Act, the Secretary of Transportation is

County, Illinois, to Jack C. Mays.

Quarter (SW1/4) of Section 19, Township 1 North, Range 1
East of the Third Principal Meridian, more particularly
described as follows:
Commencing at a point, being the Northeast corner of the
Northeast Quarter (NE1/4) of the Southwest Quarter
(SW1/4) of said Section 19, thence Westerly along the
North Line of said Southwest Quarter (SW1/4) a distance
of 407.64 feet to an iron pin set, hereinafter known as
the point of beginning; thence parallel with the East
Line of said Southwest Quarter (SW1/4) on an assumed
bearing of S00° 01'31"E, a distance of 471.27 feet, to an
iron pin set; thence N82° 40'01"E, a distance of 29.41

Meridian, Village of Peoria Heights, Peoria County,
Illinois, described in detail as follows:
Beginning at the northwest corner of Lot 23 of Pershing
Homes Subdivision; thence on an assumed bearing of North
89 degrees 59 minutes 27 seconds East along the Southerly
Right of Way line of War Memorial Drive a distance of
2.00 feet; thence South 03 degrees 28 minutes 44 seconds

It is understood and agreed that there is no existing
right of access nor will access be permitted in the future by
the State of Illinois, Department of Transportation from or
over the premises above described to and from FAP Route 172
(War Memorial Drive), previously declared a freeway.
Section 5-25. Upon the payment of the sum of $850 to the
State of Illinois, and subject to the conditions set forth in
Section 5-100 of this Act, the easement for highway purposes
acquired by the People of the State of Illinois is released
over and through the following described land in Macoupin
County, Illinois:

described as follows:
Commencing at the southeast corner of said Southeast
Quarter; thence North 00 degrees 57 minutes 45 seconds
East along the east line of said Southeast Quarter, a
distance of 783.26 feet to the northerly right of way
line of Illinois Route 108; thence South 87 degrees 27
minutes 40 seconds West along said northerly right of way
line, a distance of 801.19 feet to the point of
beginning.
From said point of beginning; thence continuing South 87
degrees 27 minutes 40 seconds West, a distance of 139.81

Section 5-35. Upon the payment of the sum of $7,500 to
the State of Illinois, and subject to the conditions set
forth in Section 5-100 of this Act, the easement for highway
purposes acquired by the People of the State of Illinois is
released over and through the following described land in
Peoria County, Illinois:

A part of the Northeast Quarter of the Southwest Quarter
of Section 11, Township 8 North, Range 7 East of the
Fourth Principal Meridian in the County of Peoria and
State of Illinois, described in detail as follows.
Beginning at the northwest corner of Lot 25 in Gray's
Summit, a subdivision of the Northeast Quarter of the
Southwest Quarter of said Section 11, as shown by a plat
recorded in the Peoria County Recorder's Office in Plat
Book P on Page 67, said corner being 50.00 feet normally
distant southwesterly from the centerline of existing
pavement in place of Federal Aid Route 669 (Illinois
Marked Route 116); thence South 47 Degrees 44 Minutes 20
Seconds West, (197.35 feet Recorded) along the west line
of said Lot 25 and its extention southwesterly to a point

Section 5-40. Upon the payment of the sum of $120,000 to
the State of Illinois, the rights or easements of access,
crossing, light, air, and view from, to, and over the
following described line and IL Route 132 are restored
subject to permit requirements of the State of Illinois,
Department of Transportation.
Parcel No. 1WY0827:
That part of the south line of Out-Lot "F" in Brookside
Phase 1, being a subdivision of the West Half of the
Southeast Quarter of Section 8, Township 45 North, Range
11 East of the Third Principal Meridian, (except that
part thereof lying within the right of way of F.A.S.
Route 3) and also the East Half of the Southwest Quarter
of Section 8 aforesaid, (excepting that part thereof
lying within the right of way of F.A.S. Route 3),
according to the plat thereof recorded October 31, 1988
as document number 2735811, in Lake County, Illinois,
described as follows:
Commencing at the southeast corner of said Out-Lot "F" in

beginning of the line over which access rights are to be

Section 5-45. Upon the payment of the sum of $84,000 to
the State of Illinois, and subject to the condition set forth
in Section 5-100 of this Act, the Secretary of Transportation
is authorized to convey by quitclaim deed all right, title,
and interest in and to the following described land in DuPage
County, Illinois, to Public Storage, Inc., a California
Corporation.

Lots 11 and 12, except the South 100.00 feet of said Lots
11 and 12, in Block 1 of Westlands Unit Number One, being
a subdivision of part of the Southeast Quarter of Section
15, Township 39 North, Range 11 East of the Third

recorded September 25, 1952 as document number 663154, in
DuPage County, Illinois.

It is understood and agreed that there is no existing

future by the state of Illinois, Department of
Transportation, from or over the line below described to
and from FAP Route 347 (IL 38), previously declared a
freeway.
The north line of the South 100.00 feet of Lots 11, 12,
and 13, and the north line of the South 100.00 feet of
the 30.00 foot private easement lying adjacent to and
East of said Lot 13, in Block 1 of Westlands Unit Number
One, being a subdivision of part of the Southeast Quarter
of Section 15, Township 39 North, Range 11 East of the
Third Principal Meridian, according to the plat thereof

Section 5-50. Upon the payment of the sum of $4,900 to
the State of Illinois, the rights or easements of access,
crossing, light, air, and view from, to, and over the
following described line and FA Route 5 (US 66) are restored
subject to permit requirements of the State of Illinois,
Department of Transportation.

A part of the Southeast Quarter of Section 21, Township
28 North, Range 5 East of the Third Principal Meridian,
described as follows:
Commencing at the point on the south line of said
Southeast Quarter lying 447.90 feet west of the southeast
corner thereof; thence North 00 degrees 15 minutes 30
seconds West 611.68 feet, along the existing west right
of way line, to the Point of Beginning of the Release Of
Access Control at a point lying 125.00 feet right of the
survey line of F.A. Route 5 at Station 1497+95.17; thence
North 00 degrees 15 minutes 30 seconds West 205.00 feet,
along said west right of way line, to a point lying
125.00 feet right of said survey line at Station
1495+90.17, said point being the termination of said
access release, the total length of release being 205.00
linear feet, being situated in Livingston County,
Illinois.
Section 5-55. Upon the payment of the sum of $100 to the
State of Illinois, the rights or easements of access,
crossing, light, air, and view from, to, and over the
following described line are restored subject to permit
requirements of the State of Illinois, Department of
Transportation.
Parcel No. 675X202:
A part of the Northwest Quarter of Section 4, Township 14
North, Range 12 West of the Third Principal Meridian,
Scott County, Illinois, described as follows:
Commencing at the northwest corner of the Northeast
Quarter of the Southeast Quarter of Section 7, Township
14 North, Range 12 West of the Third Principal Meridian;
thence North 89 degrees 27 minutes 00 seconds East,
3947.0 feet; thence North 00 degrees 08 minutes 00
seconds West, 3727.0 feet; thence North 00 degrees 43
minutes 00 seconds West, 4209.0 feet to P.I. Station
318+88.7 Illinois Route 36; thence along said centerline,
North 89 degrees 42 minutes 00 seconds East, 3768.7 feet
to centerline Station 281+20; thence South 00 degrees 18
minutes 00 seconds East, 35.00 feet to a point on the
southerly existing right of way of said Illinois Route 36
being 35.00 feet left of centerline Station 281+20.00
also being the point of beginning of the line of access
control to be released; thence along said southerly right

1120.0 feet to a point being 35.00 feet left of Station
270+00.00 said point being the point of termination of
the release of access control.
The above description for the release of access control
refers to a part of F. A. Route 36, Section 22RS, Eminent
Domain Case No. H-67-1 in Scott County.
Section 5-60. Upon the payment of the sum of $800 to the
State of Illinois, and subject to the conditions set forth in
Section 5-100 of this Act, the easement for highway purposes
acquired by the People of the State of Illinois is released
over and through the following described land in Adams
County, Illinois.

A part of the Northwest Quarter of the Northwest Quarter
of Section 22, Township 3 South, Range 7 West of the
Fourth Principal Meridian, Adams County, Illinois,
described as follows:
Commencing at the northwest corner of the Northwest
Quarter of said Section 22; thence along the west line of
the Northwest Quarter of said Section 22, South 00
degrees 56 minutes 17 seconds West, 1319.41 feet to the
southwest corner of the Northwest Quarter of the
Northwest Quarter of said Section 22; thence along the
south line of the Northwest Quarter of said Northwest

234.30 feet to a point being 70.00 feet normal distance

Quarter of Section 6, a point on the centerline of Allen
Road in the City of Peoria; thence North 00 Degrees 04
Minutes 56 Seconds East, 826.89 feet along the West line
of said Southeast Quarter of Section 6 to a point 8.62
feet normally distant easterly from the said centerline
of Allen Road; thence North 89 Degrees 20 Minutes 53
Seconds East, 66.38 feet to a point on the existing
easterly right of way line of said Allen Road, said point
being 75.00 feet normally distant easterly from the said
centerline of Allen Road and the Point of Beginning.
From the Point of Beginning thence southeasterly 976.70
feet along a curve concave northeasterly having a radius
of 945.19 feet and a long chord of 933.82 feet bearing

normally distant northerly from the centerline of Pioneer

Sections, if any payment is required, shall record the
certified document in the Recorder's Office in the county

(b) The conveyance of real property authorized by
subsection (a) shall be made subject to: (1) existing public
utilities, existing public roads, and any and all
reservations, easements, covenants and restrictions of
record; (2) the existing lease (or leases) to the Confluence
Development Corporation; and (3) the express condition that
if said real property ceases to be used for public
recreational purposes, it shall revert to the State of
Illinois, Department of Natural Resources.
Section 10-40. The Director of Natural Resources is
authorized to convey, for the consideration of $1, the
following described real property to the Village of Lemont by
quitclaim deed, subject to the conditions that the real
property be used for public open space and trail purposes,
that if the real property ceases to be used for public open
space and trail purposes it shall revert back to the
Department of Natural Resources, and that the grantee pays
any costs for the transfer:
Illinois and Michigan Canal, including the ninety-foot
Reserves on either side thereof, located or lying within the
Northeast Quarter of Section 25, Township 37 North, Range 10
East of the Third Principal Meridian, in Will County,
Illinois.
Section 10-45. The Director of Natural Resources is
authorized to convey, for the consideration of $1, the
following described real property to the Village of Matteson
by quitclaim deed, subject to the conditions that the real
property be used for public open space and trail purposes,
that if the real property ceases to be used for public open
space and trail purposes it shall revert back to the
Department of Natural Resources, and that the grantee pays
any costs for the transfer:

Section 10-55. (a) Upon the payment of a sum equal to
the appraised fair market value of the real estate to the
Department of Natural Resources, the Director of Natural
Resources, on behalf of the State of Illinois, is authorized
to execute and deliver to the Makanda Evergreen Cemetery
Association, its successors and assigns, a quit claim deed to
the following described real property, provided that the
Grantee pay title and closing costs, to wit:
Two (2) acres in the Southeast Quarter of the Southwest
Quarter of Section 27, Township 10 South, Range 1 West of
the Third Principal Meridian, Jackson County, Illinois,
being described as follows: A strip of land of uniform
width containing 2.00 acres, adjoining the East line of
the existing cemetery which lies northerly and easterly
of the public road, said strip being bounded on the North
by the easterly prolongation of the North line of said
cemetery, and being bounded on the South by the northerly
right-of-way line of said public road, a more accurate
legal description to be prepared from an accurate land
survey to be made by an Illinois Professional Land
Surveyor.
(b) The conveyance of real property authorized by
subsection (a) is subject to: (i) existing public utilities,
existing public roads, and any and all reservations,
easements, encumbrances, covenants, and restrictions of
record and (ii) the express condition that if said real
property ceases to be used for burial ground purposes it
shall revert to the State of Illinois, Department of Natural
Resources.
Section 10-60. The Director of Natural Resources, on
behalf of the State of Illinois, is authorized to execute and
deliver to Libman Equipment Partnership, an Illinois general
partnership, for and in consideration of $1 paid to the
Department, a quit claim deed to the following described real
property, provided that the partnership pays all title and
closing costs, to wit:
Commencing at an iron pipe survey monument reset at the
Northwest corner of the Southwest Quarter of Section 3,
Township 14 North, Range 8 East of the Third Principal
Meridian, Douglas County, Illinois; thence North 89
degrees 40 minutes 36 seconds East along the North line
of the Southwest Quarter of said Section 3, a distance of
191.76 feet to an iron pipe survey monument set on the
East line of the Kansas State Bank tract as filed for
record in Book 405 at Page 264 in the office of the
Recorder of Douglas County, Illinois, for the Point of
Beginning; thence North 89 degrees 40 minutes 36 seconds
East along the North line of the Southwest Quarter of
said Section 3, a distance of 371.62 feet to an iron pipe
survey monument set on the North line of the Libman
Equipment Partnership Tract 2 as filed for record in Book
494 at Page 261 in the office of the Recorder of Douglas
County, Illinois, said line also being the North
right-of-way line of the former Penn Central Railroad;
thence South 85 degrees 55 minutes 25 seconds West along
the North line of said Libman Equipment Partnership Tract
2, said line also being the North right-of-way line of
said former Penn Central Railroad, a distance of 209.16

Section 10-95. The Director of Natural Resources shall
obtain a certified copy of the portions of this Act
containing the title, the enacting clause, the effective
date, the appropriate Sections containing the land
descriptions of property to be transferred, and this Section
within 60 days after this Act's effective date and, upon
receipt of payment required by the appropriate Sections,
shall record the certified document in the Recorder's office
in the county in which the land is located.
Article 15.
Section 15-5. (a) The Mt. Vernon Township High School
District, No. 201, Jefferson County, Illinois, (hereinafter
"Mt. Vernon School District") owns the following described
real estate:
The Northern 63.5 feet of Lots 4, 5, 6, and 7 in Block 12
of Green's Addition of Storms' Survey of the Town, now
City, of Mt. Vernon, situated in the County of Jefferson
and State of Illinois, and containing 0.46 acres more or
less.
(b) The State of Illinois owns the following described
real estate, which is under the control of the Department of
Military Affairs:
Lots 4, 5 and 6 in Block 6 of Storms' Survey of the Town,
now City, of Mt. Vernon; except the North 14 feet of Lot
4; and also except that part of Lots 4, 5, and 6
described as follows: Beginning at the Southwest corner
of Lot 6 and running thence East along the North boundary
line of Jordan Street 60 feet; thence North parallel with
Johnson Alley 165 feet; thence West parallel with Jordan
Street 60 feet; thence South along the East boundary of
Johnson Alley 165 feet to the place of beginning;
situated in the County of Jefferson and State of
Illinois, and containing 0.55 acres more or less.
(c) The City of Mt. Vernon owns the following described
real estate, which is currently used as an alley:
Beginning at the Northeast corner of Lot 4 in Block 12 of
Green's Addition of Storms' Survey of the Town, now City,
of Mt. Vernon; thence West along the North boundary line
of Lots 4, 5, 6, and 7 a distance of 188 feet; thence
North 16 feet; thence East along the South boundary line
of Lot 1 a distance of 188 feet; thence South 16 feet to
the place of beginning; situated in the County of
Jefferson and State of Illinois, and containing 0.08
acres more or less.
(d) The Adjutant General, on behalf of the State of
Illinois and the Department of Military Affairs, is
authorized to convey by quit claim deed all right, title, and
interest of the State of Illinois and the Department of
Military Affairs in and to the real estate described in
subsection (b) of this Section to the Mt. Vernon School
District upon the Mt. Vernon School District conveying by
warranty deed to the State of Illinois the fee simple title
in and to the real estate described in subsection (a) of this
Section. The authorization is contingent, however, on the
City of Mt. Vernon vacating the real estate (alley) described
in subsection (c) of this Section and that the fee simple
title in and to that entire parcel of real estate vesting in
the State of Illinois when vacated, or fee simple title is
conveyed to the State of Illinois. Furthermore, the Adjutant
General is authorized to accept conveyance of the real estate
described in subsection (b) of this Section subject to the
Right of First Purchase by the Mt. Vernon School District, if
the Department of Military Affairs ceases to use the real
estate for military purposes, upon such terms as the Adjutant
General finds acceptable.
Section 15-10. The Adjutant General shall obtain a
certified copy of the portions of this Act containing the
title, the enacting clause, the effective date, the
appropriate Section containing the land descriptions of the
property to be transferred and this Section within 60 days
after its effective date, and upon receipt of payment
required by the Section, if any payment is required, shall
record the certified document in the Recorder's Office in the
county in which the land is located.
ARTICLE 20.
Section 20-5. Legislative findings. The General Assembly
finds that (i) Maryville Academy has provided valuable and
urgently needed services to the children of the State of
Illinois for many years; (ii) the New Horizon Center for the
Developmentally Disabled has provided schooling and housing
for the developmentally disabled; and (iii) Chicago Read
Mental Health Center has played a long standing role in the
history of the City of Chicago and Cook County.
Section 20-10. The Director of Central Management
Services is authorized to:
(a) convey by quit claim deed for $1 buildings A &
B of the former Henry Horner School property located on
Oak Park Ave, Chicago, Illinois to Maryville Academy,
provided however that should the property fail to be used
by Maryville Academy for charitable or educational
purposes, the title shall revert to the State of
Illinois;
(b) convey by quit claim deed approximately 5 acres
of the grounds of the former Henry Horner School located
on Oak Park Avenue, Chicago, Illinois for $1 upon
identification and survey of a site mutually agreeable to
the parties to New Horizon Center for the Developmentally
Disabled, provided that should the property fail to be
used by New Horizon Center for the Developmentally
Disabled for charitable or educational purposes, title
shall revert to the State of Illinois;
(c) convey by Quit Claim Deed for $1 to the City of
Chicago the following described real property:
A PARCEL OF LAND, APPROXIMATELY 16,000 SQUARE FEET
ON AND ALONG THE NORTH SIDE OF WEST IRVING PARK
ROAD, HAVING APPROXIMATELY 135 FEET OF FRONTAGE ON
SAID WEST IRVING PARK ROAD AND A DEPTH OF
APPROXIMATELY 125 FEET, HAVING ITS EASTERLY BOUNDARY
PARALLEL TO AND APPROXIMATELY 1,111 FEET WEST OF THE
WEST PROPERTY LINE OF NORTH NARRAGANSETT AVENUE, AND
ITS WESTERLY BOUNDARY BEING PARALLEL TO AND 135 FEET
WEST OF THE EASTERLY BOUNDARY LINE, ALL IN THE
COUNTY OF COOK AND STATE OF ILLINOIS.
Provided however, should the property fail to be used by
the Grantee for public purposes, title shall revert to
the State of Illinois;
(d) take steps to preserve, landscape, memorialize
and protect unmarked historic cemetery grounds located by
archeological survey on the grounds of Chicago Read
Mental Health Center. This subsection shall also allow
the relocation of the remains pursuant to regulations and
procedures established by the Historic Preservation
Agency when deemed necessary by the Director of Central
Management Services. For the purpose of the relocation of
such remains, the Secretary of Human Services is
designated next of kin when it is not possible to
definitively establish the identity of any such remains;
(e) in order to facilitate the conveyances
referenced in subsections (a) and (b) after consultation
with the Secretary of Transportation, the Secretary of
Human Services, and the Director of Commerce and
Community Affairs and upon obtaining necessary
appraisals, surveys, and environmental reports, and in
accordance with and in coordination with any pre-existing
redevelopment agreement, convey title by quit claim deed
to Chicago Read Joint Venture, Limited Partnership to
surplus property located within the area bordered by
Harlem Avenue, West Irving Park Road, North Narragansett
Avenue, West Montrose Avenue, and Forest Preserve Drive,
Chicago, Illinois, but excluding the area comprised of
the property of the former Henry Horner School and the
property referred to as the "Phase Three Property" under
the Chicago Read-Dunning Redevelopment Agreement, at fair
market value and on such terms and conditions necessary
to bring about the orderly redevelopment of such surplus
property, provided however that "surplus property" as
described in this Section shall not include buildings and
grounds currently under the jurisdiction of the
Department of Human Services unless specifically
consented to by the Secretary of Human Services; and
(f) accept replacement State facilities constructed
in order to relocate State operations located in
facilities to be replaced or otherwise transferred to
coordinate with necessary redevelopment.
Section 20-15. The Director of Central Management
Services shall obtain a certified copy of the portions of
this Act containing the title, the enacting clause, the
effective date, the appropriate Sections containing the land
descriptions of the property to be transferred, and this
Section within 60 days after its effective date, and upon
receipt of payment required by the Section or Sections, if
payment is required, shall record the certified document in
the Recorder's Office in the county in which the land is
located.
ARTICLE 25.
Section 25-5. The Director of Corrections is hereby
authorized to convey to the City of Chester, Illinois in
consideration of $22,500 and other agreements entered into
between the Department of Corrections and the City of Chester
all right, title, and interest of the State of Illinois in
and to the real estate, including any and all fixtures and
appurtenances thereto, located in Randolph County, Illinois,
and legally described as follows:
That portion of Lot 3, Block 18, Mather, Lamb and
Company's Second Addition to the City of Chester,
Illinois, in Section 24, Township 7 South, Range 7 West
of the Third Principal Meridian, in Randolph County,
Illinois, described as follows:
Beginning at the Northerly corner of Lot 3 aforesaid,
thence along the northeasterly line of said Lot 3 a
distance of 60.00 feet to the easterly line of Lot 3;
thence along the southeasterly line of Lot 3 a distance
of 55.48 feet to a point in said line; thence
northwesterly a distance of 60.01 feet to a point in the
northwesterly line of said Lot 3; thence northeasterly
along the northwesterly line of said Lot 3 a distance of
55.00 feet to the place of beginning; containing 0.07609
acre, more or less.
Section 25-10. The Director of Corrections shall obtain
a certified copy of the portions of this Act containing the
title, the enacting clause, the effective date, the
appropriate Section containing the land description of the
property to be transferred or otherwise affected, and this
Section within 60 days after its effective date and, upon
receipt of payment required by the Section, if any payment is
required, shall record the certified document in the
Recorder's Office in the county in which the land is located.
ARTICLE 90.
Section 90-5. The Illinois Municipal Code is amended by
changing Section 7-1-1 as follows:

Sec. 7-1-1. Annexation of contiguous territory. Any
territory that is not within the corporate limits of any
municipality but is contiguous to a municipality may be
annexed to the municipality as provided in this Article. For
the purposes of this Article any territory to be annexed to a
municipality shall be considered to be contiguous to the
municipality notwithstanding that the territory is separated
from the municipality by a railroad or public utility
right-of-way, but upon annexation the area included within
that right-of-way shall not be considered to be annexed to
the municipality.
Except in counties with a population of more than 500,000
but less than 3,000,000, territory which is not contiguous to
a municipality but is separated therefrom only by a forest
preserve district may be annexed to the municipality pursuant
to Sections 7-1-7 or 7-1-8, but only if the annexing
municipality can show that the forest preserve district
creates an artificial barrier preventing the annexation and
that the location of the forest preserve district property
prevents the orderly natural growth of the annexing
municipality. It shall be conclusively presumed that the
forest preserve district does not create an artificial
barrier if the property sought to be annexed is bounded on at
least 3 sides by (i) one or more other municipalities (other
than the municipality seeking annexation through the existing
forest preserve district), (ii) forest preserve district
property, or (iii) a combination of other municipalities and
forest preserve district property. It shall also be
conclusively presumed that the forest preserve district does
not create an artificial barrier if the municipality seeking
annexation is not the closest municipality to the property to
be annexed. The territory included within such forest
preserve district shall not be annexed to the municipality
nor shall the territory of the forest preserve district be
subject to rights-of-way for access or services between the
parts of the municipality separated by the forest preserve
district without the consent of the governing body of the
forest preserve district. The changes made to this Section by
this amendatory Act of 91st General Assembly are declaratory
of existing law and shall not be construed as a new
enactment.
In counties that are contiguous to the Mississippi River
with populations of more than 200,000 but less than 255,000,
a municipality that is partially located in territory that is
wholly surrounded by the Mississippi River and a canal,
connected at both ends to the Mississippi River and located
on property owned by the United States of America, may annex
noncontiguous territory in the surrounded territory under
Sections 7-1-7, 7-1-8, or 7-1-9 if that territory is
separated from the municipality by property owned by the
United States of America, but that federal property shall not
be annexed without the consent of the federal government.
When any land proposed to be annexed is part of any Fire
Protection District or of any Public Library District and the
annexing municipality provides fire protection or a public
library, as the case may be, the Trustees of each District
shall be notified in writing by certified or registered mail
before any court hearing or other action is taken for
annexation. The notice shall be served 10 days in advance.
An affidavit that service of notice has been had as provided
by this Section must be filed with the clerk of the court in
which the annexation proceedings are pending or will be
instituted or, when no court proceedings are involved, with
the recorder for the county where the land is situated. No
annexation of that land is effective unless service is had
and the affidavit filed as provided in this Section.
The new boundary shall extend to the far side of any
adjacent highway and shall include all of every highway
within the area annexed. These highways shall be considered
to be annexed even though not included in the legal
description set forth in the petition for annexation. When
any land proposed to be annexed includes any highway under
the jurisdiction of any township, the Township Commissioner
of Highways and the Board of Town Trustees shall be notified
in writing by certified or registered mail before any court
hearing or other action is taken for annexation. In the event
that a municipality fails to notify the Township Commissioner
of Highways and the Board of Town Trustees of the annexation
of an area within the township, the municipality shall
reimburse that township for any loss or liability caused by
the failure to give notice. If any municipality has annexed
any area before October 1, 1975, and the legal description in
the petition for annexation did not include the entire
adjacent highway, any such annexation shall be valid and any
highway adjacent to the area annexed shall be considered to
be annexed notwithstanding the failure of the petition to
annex to include the description of the entire adjacent
highway.
Any annexation, disconnection and annexation, or
disconnection under this Article of any territory must be
reported by certified or registered mail by the corporate
authority initiating the action to the election authorities
having jurisdiction in the territory and the post office
branches serving the territory within 30 days of the
annexation, disconnection and annexation, or disconnection.
Failure to give notice to the required election
authorities or post office branches will not invalidate the
annexation or disconnection. For purposes of this Section
"election authorities" means the county clerk where the clerk
acts as the clerk of elections or the clerk of the election
commission having jurisdiction.
No annexation, disconnection and annexation, or
disconnection under this Article of territory having electors
residing therein made (1) before any primary election to be
held within the municipality affected thereby and after the
time for filing petitions as a candidate for nomination to
any office to be chosen at the primary election or (2) within
60 days before any general election to be held within the
municipality shall be effective until the day after the date
of the primary or general election, as the case may be.
For the purpose of this Section, a toll highway or
connection between parcels via an overpass bridge over a toll
highway shall not be considered a deterrent to the definition
of contiguous territory.
When territory is proposed to be annexed by court order
under this Article, the corporate authorities or petitioners
initiating the action shall notify each person who pays real
estate taxes on property within that territory unless the
person is a petitioner. The notice shall be served by
certified or registered mail, return receipt requested, at
least 20 days before a court hearing or other court action.
If the person who pays real estate taxes on the property is
not the owner of record, then the payor shall notify the
owner of record of the proposed annexation.

Section 99-5. Effective date. This Act takes effective
upon becoming law.
