House Sponsors: FEIGENHOLTZ-HAMOS-OSTERMAN Short description: MH-DD CONFIDENTIAL-COLLECTION Synopsis of Bill as introduced: Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that records and communications of a recipient may be disclosed when disclosure is necessary to collect sums or receive third party payment representing charges for mental health or developmental disabilities services provided by a therapist or agency to a recipient. Provides that disclosure is limited to information needed to pursue collection and the information may not be used for any other purposes nor may it be redisclosed except in connection with collection activities. Effective immediately. SENATE AMENDMENT NO. 1. Provides that whenever records are disclosed for the purposes of collecting sums or receiving third party payment for charges for mental health or developmental disabilities services provided by a therapist or agency, the recipient of the records shall be advised in writing that any person who discloses mental health records and communications in violation of the Act is subject to the civil and criminal penalties provided for in the Act.
