Provides that a defendant charged with first degree murder is not eligible for a sentence of death when: (1) identity is the issue in the case and the court determines that the State's ability to meet its burden to prove the defendant guilty beyond a reasonable doubt depends upon the testimony of a sole eyewitness who will testify that the defendant is the perpetrator of the offense or (2) the defendant's case has previously been tried by the court and a jury and, following the trial, the jury was unable to reach a unanimous verdict on the defendant's guilt of the offense.
