House Sponsors: MURPHY. Short description: PEN CD-ART 17-SURVIVOR-REMARRY Synopsis of Bill as introduced: Amends the Chicago Teachers Article of the Illinois Pension Code. Provides that attainment of age 18 does not terminate the children's pension of a child who is disabled and was dependent upon a deceased teacher at the time of his or her death. Deletes the provision that if a surviving spouse is under age 50 and there are no eligible children of the contributor and his surviving spouse, payment of the survivor's pension shall begin when the surviving spouse attains age 50. Eliminates the requirement that a person be married to a contributor for at least 1.5 years immediately prior to the contributor's death or retirement and on the date of the last termination of the contributor's service in order to receive a survivor's pension. Provides that, beginning January 1, 2003, remarriage at any age by a surviving spouse will not terminate his or her survivor's pension. Allows a surviving spouse whose survivor's pension was terminated due to remarriage to reinstate his or her survivor's pension upon repayment of the amount of the survivor's refund plus interest. Amends the State Mandates Act to require implementation without reimbursement. Effective immediately.
