Senate Sponsors: RAUSCHENBERGER Short description: WATER QUANTITY PROTECTION Synopsis of Bill as introduced: Creates the Water Quantity Protection Act of 2001. Provides that after the effective date of the Act, no facilities for the withdrawal of groundwater or surface water may be constructed, installed, or operated without the approval of the Department of Natural Resources when (i) the proposed rate of withdrawal is in excess of 2,000,000 gallons per day or (ii) the amount of water to be withdrawn will significantly and adversely affect or reduce the availability of water for other uses. Lists factors the Department must consider before granting approval for the withdrawal of groundwater or surface water. Limits approvals to certain listed situations. Allows the Pollution Control Board to review the Department's decisions. Creates a Water Quantity Protection Advisory Committee to review, evaluate, and make recommendations to the Department for rules to implement the Act. Allows the Pollution Control Board, on the Department's recommendations, to adopt rules necessary to implement the Act. Preempts home rule powers. Effective immediately. FISCAL NOTE (Department of Natural Resources) Fiscal impact is estimated at $1,000,000 for increased staff, operational support costs, technical studies, and groundwater investigations.
