House Sponsors: FRANKS. Short description: CIV PRO-MED MALPRACTICE-SANCTN Synopsis of Bill as introduced: Amends the Civil Practice Article of the Code of Civil Procedure. In the Section concerning pleading in healing art malpractice cases, adds a provision that the court may impose sanctions against a party or attorney if it determines that there has been a willful failure to comply with the requirements of the Section or that the action is frivolous or otherwise not commenced in good faith. Provides that appropriate sanctions include a bar against presenting a claim or defense and an order to pay damages and costs. Effective immediately.
