MADIGAN,L. New Act 215 ILCS 97/20 215 ILCS 106/20 Creates the Family Health Insurance Program Act and amends the Illinois Health Insurance Portability and Accountability Act and the Children's Health Insurance Program Act. Creates a Family Health Insurance Program to be administered by the Department of Public Aid. Provides for health care coverage for certain low-income families, either by subsidizing the cost of an employer-provided benefits plan or by providing health care services upon the payment of specified premiums and copayments. Requires the Department to apply for necessary federal waivers, but requires the Department to implement the program (subject to appropriations) even if some or all of the waiver requests are denied. Requires that the program be operational by January 1, 2003 at the earliest, and authorizes the Department to delay implementation of any portion of the program as to which federal matching funds are not yet approved. Repeals the Family Health Insurance Program Act on July 1, 2008. Adds coverage under the Family Health Insurance Program Act to the list of "creditable coverages" under the Illinois Health Insurance Portability and Accountability Act. As a condition of eligibility for the Children's Health Insurance Program, provides for an upper limit of income eligibility at 200% (rather than 185%) of the federal poverty level, in connection with efforts to obtain federal matching funding.
