KENNER. 20 ILCS 3930/7.5 new 50 ILCS 705/10.2 new 705 ILCS 405/5-401.5 new 720 ILCS 5/14-3 from Ch. 38, par. 14-3 725 ILCS 5/103-2.1 new 30 ILCS 805/8.27 new Amends the Code of Criminal Procedure of 1963 and the Juvenile Court Act of 1987. Provides that statements made by a suspect at a custodial interrogation at a police station or other place of detention in investigations of any criminal offense are presumed inadmissible unless electronically recorded. Provides that the presumption may be overcome by evidence that the statements were voluntary and reliable. Sets forth exceptions. Amends the Criminal Code of 1961. Exempts the electronic recordings of statements from the Eavesdropping Article of the Code. Amends the Illinois Criminal Justice Information Act. Provides that the Illinois Criminal Justice Information Authority shall make grants, subject to appropriation, to local law enforcement agencies for equipment for electronic recording of interrogations. Amends the Illinois Police Training Act. Provides that the Illinois Law Enforcement Training Standards Board shall, subject to appropriation, conduct training programs for police officers on the methods and technical aspects of conducting electronic recordings of interrogations. Amends the State Mandates Act to exempt the mandates created by the amendatory Act from reimbursement. Some provisions are effective immediately. FISCAL NOTE (Illinois State Police) If HB 5628 would become law, there would be a significant fiscal impact on the Illinois State Police of $950,000 for equipment acquisition, plus an undetermined level of capital expenditures to modify existing structures to comply with the Act, as well as undefined costs associated with officer training. Additionally, grants to cover costs of purchase of videotaping or digital video equipment for local police agencies is estimated to cost $12.5 million. This figure does not reflect costs associated with training officers or costs to cover capital improvements that may be required by local police agencies. STATE MANDATES NOTE (Illinois Community College System) In the opinion of ICCB, HB 5628 does not create a State mandate to the community colleges of Illinois.
