JOHNSON. (HAWKINSON) 730 ILCS 5/5-8-2 from Ch. 38, par. 1005-8-2 Amends the Unified Code of Corrections relating to extended term sentences. Eliminates the provision that the judge may only impose an extended term sentence when the trier of fact finds beyond a reasonable doubt that certain aggravating factors were present. Provides that certain procedural requirements must be complied with, including notification to the defendant of the alleged aggravating factors (other than the fact of a prior conviction) or inclusion of the factors in the charging instrument and proof of those factors beyond a reasonable doubt by the trier of fact. Effective immediately.
