CROSS-BERNS. New Act Creates the Uniform Athlete Agents Act. Requires agents for student athletes to register with the Department of Professional Regulation and establishes registration procedures, criteria, and requirements for these athlete agents. Provides that the application for registration is a public record. Authorizes the Department to issue a temporary registration while a registration application is pending. Provides for suspension, revocation, and non-renewal of a registration in specified circumstances. Establishes requirements for agency contracts subject to the Act. Requires both the athlete agent and the student athlete to promptly notify the appropriate educational institution after the contract is entered into. Provides an educational institution that is damaged by a violation of the Act with a civil remedy against the involved athlete agent and the student athlete. Establishes record-keeping requirements for athlete agents. Prohibits athlete agents from engaging in specified conduct, subject to criminal and administrative penalties. Includes other provisions. HOUSE AMENDMENT NO. 1. Deletes everything. Reinserts the provisions of the original bill with the following changes: Changes the short title to the Athlete Agents Act. Defines the term "Director" to mean the Director of Professional Regulation. Gives the Department of Professional Regulation powers and duties concerning the administration of the Act. Makes changes concerning the registration of a person who is certified, registered, or licensed as an athlete agent in another state. Provides that any information required by the Department of an applicant for licensure, other than financial information, is a public record. Provides that registrations under the Act expire on June 30 of each odd-numbered year. Provides that it is unlawful for a person to practice as an athlete agent if his or her license is expired and has not been renewed or reissued. Makes changes concerning fees. Provides grounds for disciplinary action. Requires the Department to provide and pay for a stenographer to preserve a record of all proceedings initiated pursuant to the Act. Provides that all final administrative decisions of the Department are subject to the Administrative Review Law. Adopts and incorporates most provisions of the Illinois Administrative Procedure Act. Imposes a penalty for returned checks. Authorizes the Director to appoint hearing officers. Imposes a penalty for unregistered practice.
