Provides that a person who willfully defaults on an order for child support may be subject to summary criminal contempt proceedings. Provides that each State agency shall suspend any license or certificate issued by that agency to a person found guilty of criminal contempt based on such a default. Provides that State's Attorneys and appropriate State officials are entitled to obtain information from employers, telephone companies, and utility companies for the purpose of locating obligors who have defaulted on child support payments. Effective immediately. JUDICIAL NOTE (Office of the Illinois Courts) Although the number of cases of willful default on child support may be large, it is unclear how many of those cases would be dealt with in a summary proceeding, or the intended scope of such proceedings. Therefore, it is not possible to determine whether the bill would increase the number of judges needed in the State. HOUSE AMENDMENT NO. 1. Further amends the Illinois Marriage and Dissolution of Marriage Act. In provisions setting forth penalties for willfully defaulting on an order for child support, adds the refusal to renew or issue a license or certificate and the restriction of a license or certificate. HOUSE AMENDMENT NO. 2. Further amends the Illinois Marriage and Dissolution of Marriage Act. In provisions concerning suspension of a license or certificate issued to a person found guilty of criminal contempt for having willfully defaulted on an order for child support, provides that no license or certificate may be suspended while an appeal of a finding of criminal contempt is pending. FISCAL NOTE (Department of Public Aid) There would be no fiscal impact to this Department. HOUSE AMENDMENT NO. 3. Deletes reference to: 750 ILCS 22/401 Deletes the bill's amendatory changes to the Uniform Interstate Family Support Act.
