92_SJ0023 SDS/92ASJR/0002/ARlb 1 SENATE JOINT RESOLUTION 2 WHEREAS, The Property Tax Extension Limitation Law 3 (PTELL) limits increases in property tax extensions to the 4 lesser of 5 percent or the increase in the national Consumer 5 Price Index for the year preceding the levy year; and 6 WHEREAS, The tax caps of PTELL were imposed by the State 7 on DuPage, Kane, Lake, McHenry, and Will counties beginning 8 with the 1991 levy year; and 9 WHEREAS, The tax caps of PTELL were imposed by the State 10 on Cook County taxing districts beginning with the 1995 levy 11 year; and 12 WHEREAS, Since the 1997 tax year, 28 downstate counties 13 have approved property tax cap referenda while nine counties 14 have defeated tax cap referenda; and 15 WHEREAS, Every year since tax caps were imposed numerous 16 pieces of legislation have been introduced seeking exceptions 17 to the tax cap limits of PTELL; and 18 WHEREAS, The General Assembly and Governor have approved 19 a number of those exceptions allowing them to become law, and 20 thus negating the local voter approval provisions of PTELL; 21 therefore, be it 22 RESOLVED, BY THE SENATE OF THE NINTY-SECOND GENERAL 23 ASSEMBLY, THE HOUSE OF REPRESENTATIVES CONCURRING HEREIN, 24 that there is created a bi-partisan Tax Cap Advisory 25 Committee to study the statewide affect of the Property Tax 26 Extension Limitation Law on residential, business and 27 farmland property taxpayers as well as the affect of tax caps 28 on local governments and school districts and their ability 29 to deliver critically needed services to the citizens they 30 serve; and be it further -2- SDS/92ASJR/0002/ARlb 1 RESOLVED, that the Tax Cap Advisory Committee shall 2 consist of 12 members; six members appointed from the House 3 of Representatives, with 3 members appointed by the Speaker 4 and 3 members appointed by the Minority Leader, with the 5 majority caucus members serving at the pleasure of the 6 Speaker and the minority caucus members serving at the 7 pleasure of the Minority Leader; and six members appointed 8 from the Senate, with the majority caucus members serving at 9 the pleasure of the Speaker and the minority caucus member 10 serving at the pleasure of the Minority Leader; all of whom 11 shall serve without compensation but shall be reimbursed for 12 their reasonable and necessary expenses; and be it further 13 RESOLVED, That the Tax Cap Committee shall meet as soon 14 as possible after at least 8 members have been appointed, 15 shall elect one member from the House and one member from the 16 Senate to serve as co-chairs by majority vote, shall hold 17 public hearings, and shall report its findings and 18 recommendations to the General Assembly by filing a copy of 19 its report with the Secretary of the Senate and the Clerk of 20 the House on or before January 1, 2002;
