92_SB2360 BOB-BI03 1 AN ACT making appropriations and reappropriations. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 ARTICLE 2 5 Division FY03. This Division contains appropriations 6 made for the fiscal year beginning July 1, 2002. 7 Section 1. The sum of $2,000,000, or so much thereof as 8 may be necessary, is appropriated from the Build Illinois 9 Bond Fund to the Department of Natural Resources for grants 10 and contracts for well plugging and restoration projects. The 11 appropriated amount shall be in addition to any other 12 appropriated amounts which can be expended for these 13 purposes. 14 Section 2. The sum of $7,000,000, or so much thereof as 15 may be necessary, is appropriated from the Build Illinois 16 Bond Fund to the Department of Natural Resources for the 17 Division of Water Resources for costs associated with the 18 repair of the Lake Michigan shoreline in Chicago. The 19 appropriated amount shall be in addition to any other 20 appropriated amounts which can be expended for these 21 purposes. 22 Section 3. The sum of $2,000,000, or so much thereof as 23 may be necessary, is appropriated from the Build Illinois 24 Bond Fund to the Environmental Protection Agency for deposit 25 into the Brownfields Redevelopment Fund for use pursuant to 26 Sections 58.13 and 58.15 of the Environmental Protection 27 Act. -2- BOB-BI03 1 Section 4. The sum of $10,000,000, or so much thereof as 2 may be necessary, is appropriated from the Build Illinois 3 Bond Fund to the Environmental Protection Agency for deposit 4 into the Hazardous Waste Fund for use pursuant to Section 5 22.2 of the Environmental Protection Act. 6 ILLINOIS COMMUNITY COLLEGE BOARD 7 Section 5. The sum of $50,000,000, or so much thereof as 8 may be necessary, is appropriated from the Build Illinois 9 Bond Fund to the Capital Development Board for the Illinois 10 Community College Board for miscellaneous capital 11 improvements including construction, capital facilities, cost 12 of planning, supplies, equipment, materials and all other 13 expenses required to complete the work at the various 14 community colleges. This appropriated amount shall be in 15 addition to any other appropriated amounts which can be 16 expended for these purposes. 17 STATEWIDE 18 Section 6. The sum of $10,000,000 is appropriated from 19 the Build Illinois Bond Fund to the Capital Development Board 20 for the Illinois Board of Higher Education for miscellaneous 21 capital improvements including construction, capital 22 facilities, cost of planning, supplies, equipment, materials, 23 services and all other expenses required to complete the work 24 at the various universities. The following named amount, or so much 6 thereof as may be necessary, is appropriated from the Build 7 Illinois Bond Fund to the Capital Development Board for the 8 Department of Human Services for the project hereinafter 9 enumerated: 10 JACKSONVILLE DEVELOPMENTAL CENTER - MORGAN 11 For upgrading the mechanicals in the 12 power plant, in addition to funds 13 previously appropriated .................... $ 1,000,000 14 Section 11. The following named amount, or so much 2 thereof as may be necessary, is appropriated from the Build 3 Illinois Bond Fund to the Capital Development Board for the 4 Department of Revenue for the project hereinafter enumerated: 5 WILLARD ICE BUILDING - SPRINGFIELD 6 For planning the curtain wall renovation ....... $ 100,000 7 Section 14. The following named amount, or so much 8 thereof as may be necessary, is appropriated from the Build 9 Illinois Bond Fund to the Capital Development Board for the 10 Department of State Police for the project hereinafter 11 enumerated: 12 STATEWIDE 13 For upgrading firing range facilities ........ $ 2,000,000 14 Section 15. The following named amount, or so much 15 thereof as may be necessary, is appropriated from the Build 16 Illinois Bond Fund to the Capital Development Board for the 17 Department of Veterans' Affairs for the project hereinafter 18 enumerated: 19 MANTENO VETERANS HOME 20 For installing humidifiers and 21 dehumidifiers, in addition to funds 22 previously appropriated ................... $ 1,000,000 23 Section 16. The sum of $10,000,000, or so much thereof 24 as may be necessary, is appropriated from the Build Illinois 25 Bond Fund to the Capital Development Board for a grant to 26 Northwestern University for planning and construction of a 27 Bio-Medical Research Facility. This appropriated amount 28 shall be in addition to any other appropriated amounts which 29 can be expended for these purposes. 30 Section 17. The sum of $3,000,000, or so much thereof as -6- BOB-BI03 1 may be necessary, is appropriated from the Build Illinois 2 Bond Fund to the Capital Development Board for a grant to 3 Northwestern University for planning, construction, and 4 equipment for a Nanofabrication and Molecular Center. This 5 appropriated amount shall be in addition to any other 6 appropriated amounts which can be expended for these 7 purposes. 8 Section 18. The sum of $30,000,000, or so much thereof 9 as may be necessary, is appropriated from the Build Illinois 10 Bond Fund to the Department of Commerce and Community Affairs 11 for grants to units of government, educational facilities and 12 not-for-profit organizations for various bondable 13 infrastructure improvements, including but not limited to 14 planning, construction, reconstruction, renovation, 15 utilities, and equipment. This appropriated amount shall be 16 in addition to any other appropriated amounts which can be 17 expended for these purposes. 18 Section 19. The sum of $13,000,000, or so much thereof 19 as may be necessary, is appropriated from the Build Illinois 20 Bond Fund to the Department of Commerce and Community Affairs 21 for a grant to the Argonne National Laboratory for the Rare 22 Isotope Accelerator for bondable infrastructure improvements. 23 This appropriated amount shall be in addition to any other 24 appropriated amounts which can be expended for these 25 purposes. 26 Section 20. The sum of $17,000,000, or so much thereof 27 as may be necessary, is appropriated from the Build Illinois 28 Bond Fund to the Department of Commerce and Community Affairs 29 for a grant to Argonne National Laboratory for the 30 Nanotechnology Institute for bondable infrastructure 31 improvements. This appropriated amount shall be in addition -7- BOB-BI03 1 to any other appropriated amounts which can be expended for 2 these purposes. 3 Section 21. The sum of $15,000,000, or so much thereof 4 as may be necessary, is appropriated from the Build Illinois 5 Bond Fund to the Department of Commerce and Community Affairs 6 for a grant to Rush Presbyterian St. Luke's Medical Center 7 for the Cohn-Biomedical Research Facility for bondable 8 infrastructure improvements. This appropriated amount shall 9 be in addition to any other appropriated amounts which can be 10 expended for these purposes. 11 Section 22. The sum of $5,000,000, or so much thereof as 12 may be necessary, is appropriated from the Build Illinois 13 Bond Fund to the Department of Commerce and Community Affairs 14 for a grant to the Illinois Institute of Technology for the 15 Biomedical Research Center for bondable infrastructure 16 improvements. This appropriated amount shall be in addition 17 to any other appropriated amounts which can be expended for 18 these purposes. 19 Section 23. The sum of $12,000,000, or so much thereof 20 as may be necessary, is appropriated from the Build Illinois 21 Bond Fund to the Department of Commerce and Community Affairs 22 for grants and loans pursuant to Article 8, Article 9 or 23 Article 10 of the Build Illinois Act. 24 Section 24. The sum of $20,000,000, or so much thereof 25 as may be necessary, is appropriated from the Build Illinois 26 Bond Fund to the Department of Natural Resources for grants 27 to museums for permanent improvements. 28 Division FY02. This Division contains appropriations 29 initially made for the fiscal year beginning July 1, 2001. -8- BOB-BI03 1 Section 1. The sum of $1,949,115, or so much thereof as 2 may be necessary and remains unexpended at the close of 3 business on June 30, 2002, from an appropriation heretofore 4 made in Article 57, Division FY02, Section 1 of Public Act 5 92-8, is reappropriated from the Build Illinois Bond Fund to 6 the Department of Natural Resources for grants and contracts 7 for well plugging and restoration projects. The sum of $7,000,000, or so much thereof as 11 may be necessary and remains unexpended at the close of 12 business on June 30, 2002, from an appropriation heretofore 13 made in Article 57, Division FY02, Section 2 of Public Act 14 92-8, is reappropriated from the Build Illinois Bond Fund to 15 the Department of Natural Resources for the Division of Water 16 Resources for costs associated with the repair of the Lake 17 Michigan shoreline in Chicago. The appropriated amount 18 shall be in addition to any other appropriated amounts which 19 can be expended for these purposes. 20 Section 3. The sum of $2,000,000, or so much thereof as 21 may be necessary and remains unexpended at the close of 22 business on June 30, 2002, from an appropriation heretofore 23 made in Article 57, Division FY02, Section 3 of Public Act 24 92-8, is reappropriated from the Build Illinois Bond Fund to 25 the Environmental Protection Agency for deposit into the 26 Brownfields Redevelopment Fund for use pursuant to Sections 27 58.13 and 58.15 of the Environmental Protection Act. 28 Section 4. The sum of $10,000,000, or so much thereof as 29 may be necessary and remains unexpended at the close of 30 business on June 30, 2002, from an appropriation heretofore 31 made in Article 57, Division FY02, Section 4 of Public Act -9- BOB-BI03 1 92-8, is reappropriated from the Build Illinois Bond Fund to 2 the Environmental Protection Agency for deposit into the 3 Hazardous Waste Fund for use pursuant to Section 22.2 of the 4 Environmental Protection Act. 5 Section 5. The sum of $25,000,000, or so much thereof as 6 may be necessary and remains unexpended at the close of 7 business on June 30, 2002, from an appropriation heretofore 8 made in Article 57, Division FY02, Section 5 of Public Act 9 92-8, is reappropriated from the Build Illinois Bond Fund to 10 the Department of Commerce and Community Affairs for grants 11 and loans pursuant to Article 8, Article 9 or Article 10 of 12 the Build Illinois Act. 13 Section 6. The sum of $11,000,000, or so much thereof as 14 may be necessary and remains unexpended at the close of 15 business on June 30, 2002, from an appropriation heretofore 16 made in Article 57, Division FY02, Section 6 of Public Act 17 92-8, is reappropriated from the Build Illinois Bond Fund to 18 the Capital Development Board for a grant to The Field Museum 19 for planning, construction and equipment for a collection 20 research center. 21 Section 7. The sum of $9,000,000, or so much thereof as 22 may be necessary and remains unexpended at the close of 23 business on June 30, 2002, from an appropriation heretofore 24 made in Article 57, Division FY02, Section 6 of Public Act 25 92-8, is reappropriated from the Build Illinois Bond Fund to 26 the Capital Development Board for a grant to the University 27 of Chicago Children's Hospital for planning, construction and 28 equipment for the Children's Comprehensive Diabetes Care 29 Center. 30 ILLINOIS COMMUNITY COLLEGE BOARD -10- BOB-BI03 1 Section 11. The sum of $50,000,000, or so much thereof 2 as may be necessary and remains unexpended at the close of 3 business on June 30, 2002, from an appropriation heretofore 4 made in Article 57, Division FY02, Section 11 of Public Act 5 92-8, is reappropriated from the Build Illinois Bond Fund to 6 the Capital Development Board for the Illinois Community 7 College Board for miscellaneous capital improvements 8 including construction, capital facilities, cost of planning, 9 supplies, equipment, materials and all other expenses 10 required to complete the work at the various community 11 colleges. This appropriated amount shall be in addition to 12 any other appropriated amounts which can be expended for 13 these purposes. 14 STATEWIDE 15 Section 13. The sum of $88,400,000, or so much thereof 16 as may be necessary and remains unexpended at the close of 17 business on June 30, 2002, from an appropriation heretofore 18 made in Article 57, Division FY02, Section 13 of Public Act 19 92-8, is reappropriated from the Build Illinois Bond Fund to 20 the Department of Commerce and Community Affairs for 21 miscellaneous capital improvements and grants including 22 construction, capital facilities, cost of planning, supplies, 23 equipment, materials and other expenses required to complete 24 the work at the various facilities. This appropriated amount 25 shall be in addition to any other appropriated amount which 26 can be expended for these purposes. 27 Section 14. The sum of $3,035,800, or so much thereof as 27 may be necessary and remains unexpended at the close of 28 business on June 30, 2002, from an appropriation heretofore 29 made in Article 57, Division FY02, Section 25 of Public Act 30 92-8, is reappropriated from the Build Illinois Bond Fund to -15- BOB-BI03 1 the Capital Development Board for the Illinois Community 2 College Board for miscellaneous capital improvements 3 including construction, capital facilities, cost of planning, 4 supplies, equipment, materials, services and all other 5 expenses required to complete the work at the various 6 community colleges. This appropriated amount shall be in 7 addition to any other appropriated amounts which can be 8 expended for these purposes. 9 Section 26. The sum of $6,964,200, or so much thereof as 10 may be necessary and remains unexpended at the close of 11 business on June 30, 2002, from an appropriation heretofore 12 made in Article 57, Division FY02, Section 26 of Public Act 13 92-8, is reappropriated from the Build Illinois Bond Fund to 14 the Capital Development Board for the Illinois Board of 15 Higher Education for miscellaneous capital improvements 16 including construction, capital facilities, cost of planning, 17 supplies, equipment, materials, services and all other 18 expenses required to complete the work at the various 19 universities. The amount of $2,000,000, or so much thereof 3 as may be necessary and remains unexpended at the close of 4 business on June 30, 2002, from an appropriation heretofore 5 made in Article 57, Division FY02, Section 27 of Public Act 6 92-8, is reappropriated from the Build Illinois Bond Fund to 7 the Department of Commerce and Community Affairs for a grant 8 to the Dominican University for bondable infrastructure 9 expenses at their capital facilities within the State. 10 Section 28. The amount of $1,000,000, or so much thereof 11 as may be necessary and remains unexpended at the close of 12 business on June 30, 2002, from an appropriation heretofore 13 made in Article 57, Division FY02, Section 28 of Public Act 14 92-8, is reappropriated from the Build Illinois Bond Fund to 15 the Department of Commerce and Community Affairs for a grant 16 to Lutheran General Hospital for bondable infrastructure 17 expenses at their capital facilities within the State. 18 Section 29. The amount of $1,000,000, or so much thereof 19 as may be necessary and remains unexpended at the close of 20 business on June 30, 2002, from an appropriation heretofore 21 made in Article 57, Division FY02, Section 29 of Public Act 22 92-8, is reappropriated from the Build Illinois Bond Fund to 23 the Department of Commerce and Community Affairs for a grant 24 to Lincoln College for bondable infrastructure expenses at 25 their capital facilities within the State. 26 Section 30. The amount of $49,500, or so much thereof 6 as may be necessary and remains unexpended on June 30, 2002, 7 from appropriations heretofore made for such purposes in 8 Article 57, Division FY87a, Section 6-4.4 of Public Act 92-8, 9 as amended, is reappropriated from the Build Illinois 10 Purposes Fund to the Department of Transportation for a grant 11 to Canteen Township in St. Clair County for road repairs. 12 Section 6-4.8. The amount of $198,000, or so much 13 thereof as may be necessary and remains unexpended on June 14 30, 2002, from appropriations heretofore made for such 15 purposes in Article 57, Division FY87a, Section 6-4.8 of 16 Public Act 92-8, as amended, is reappropriated from the Build 17 Illinois Purposes Fund to the Department of Natural Resources 18 for a recreational and flood control project and retention 19 basin in the City of Sycamore. 20 Section 6-4.18. The amount of $99,000, or so much 21 thereof as may be necessary and remains unexpended on June 22 30, 2002, from appropriations heretofore made for such 23 purposes in Article 57, Division FY87a, Section 6-4.18 of 24 Public Act 92-8, as amended, is reappropriated from the Build 25 Illinois Purposes Fund to the Department of Transportation 26 for a grant to the Village of Swansea to resurface local 27 roads and repair and replace gutters and curbs. 28 Section 6-4.28. The reappropriations in this Division 2 continue certain appropriations initially made for the fiscal 3 years beginning July 1, 1985, for the purpose of the Build 4 Illinois Program set forth below. 5 Section 8-1.21. The amount of $189,520, or so much 6 thereof as may be necessary and remains unexpended on June 7 30, 2002, from appropriations heretofore made for such 8 purposes in Article 57, Division FY86, Section 8-1.21 of 9 Public Act 92-8, as amended, is reappropriated from the Build 10 Illinois Bond Fund to the Department of Natural Resources for 11 the completion of the following projects at the approximate 12 costs set forth below: 13 Lower Des Plaines River at Tributaries Watershed 14 - Cook and DuPage Counties - For 15 construction of drainage, flood control, 16 recreation and related improvements and 17 facilities in the Lower Des Plaines 18 Watershed; and for necessary land 19 acquisition, relocation, and related 20 expenses, all in general conformance with 21 the Lower Des Plaines River and Tributaries 22 Watershed Work plan in cooperation with the 23 U.S. Soil Conservation Service and local 24 governments sponsoring this Federal 25 Flood Control project .......................$ 189,520 26 Section 8-1.22. The amount of $500,000, or so much 3 thereof as may be necessary and remains unexpended on June 4 30, 2002, from appropriations heretofore made for such 5 purposes in Article 57, Division FY86, Section 8-2.28 of 6 Public Act 92-8, as amended, is reappropriated from the Build 7 Illinois Bond Fund to the Department of Natural Resources to 8 assist in planning and construction of a water retention 9 project on Tyler Creek. 10 Section 8-2.33. The amount of $50,000, or so much 11 thereof as may be necessary and remains unexpended on June 12 30, 2002, from appropriations heretofore made for such 13 purposes in Article 57, Division FY86, Section 8-2.33 of 14 Public Act 92-8, as amended, is reappropriated from the Build 15 Illinois Bond Fund to the Department of Natural Resources for 16 feasibility, engineering, and economic and environmental 17 studies on the LaMoine Lake Project. 18 Section 8-5.3. The amount of $2,000,000, or so much 19 thereof as may be necessary and remains unexpended on June 20 30, 2002, from appropriations heretofore made for such 21 purposes in Article 57, Division FY86, Section 8-5.3 of 22 Public Act 92-8, as amended, is reappropriated from the Build 23 Illinois Bond Fund to the Illinois Community College Board 24 for the City Colleges of Chicago for costs associated with 25 planning, utilities, site improvements, repairs, renovation, 26 remodeling, and construction of Job Training Centers. 27 Section 8-5.6. The amount of $460,003, or so much 28 thereof as may be necessary and remains unexpended on June 29 30, 2002, from appropriations heretofore made for such 30 purposes in Article 57, Division FY86, Section 8-5.6 of -71- BOB-BI03 1 Public Act 92-8, as amended, is reappropriated from the Build 2 Illinois Bond Fund to the Department of Transportation as a 3 grant to the City of Chicago for a viaduct and roadway 4 improvement program. 5 Division FY86-FY93. The reappropriations in this 6 Division continue certain appropriations initially made for 7 the fiscal years beginning July 1, 1985 through 1992, 8 combined for the purpose of the Build Illinois Program set 9 forth below. 10 Section 10A. The amount of $8,387,599, or so much 11 thereof as may be necessary and remains unexpended on June 12 30, 2002, from appropriations heretofore made for such 13 purposes in Article 57, Division FY89, Section 10A of Public 14 Act 92-8, as amended, is reappropriated from the Build 15 Illinois Bond Fund to the Environmental Protection Agency for 16 grants to units of local government for sewer systems and 17 wastewater treatment facilities pursuant to rules and 18 procedures established under the Anti-Pollution Bond Act. 19 Section 10B. The amount of $73,379,719, or so much 20 thereof as may be necessary, and remains unexpended on June 21 30, 2002, from appropriations heretofore made for such 22 purposes in Article 57, Division FY90, Section 10B of Public 23 Act 92-8, as amended, is reappropriated from the Build 24 Illinois Bond Fund to the Environmental Protection Agency for 25 wastewater compliance grants to units of local government or 26 sewer systems and wastewater treatment facilities pursuant to 27 procedures and rules established under the Anti-Pollution 28 Bond Act. These grants are limited to projects for which the 29 local government provides at least 30% of the project cost. 30 There is an approved project compliance plan, and there is an 31 enforceable compliance schedule prior to the grant award. The -72- BOB-BI03 1 grant award will be based on eligible project cost contained 2 in the approved compliance plan. 3 Section 10E. The amount of $162,168, or so much thereof 4 as may be necessary, and remains unexpended on June 30, 2002 5 from appropriations heretofore made for such purposes in 6 Article 57, Division FY91, Section 10E of Public Act 92-8, as 7 amended, is reappropriated from the Build Illinois Bond Fund 8 to the Capital Development Board for the University of 9 Illinois for miscellaneous capital improvements including 10 construction, reconstruction, remodeling, improvement, repair 11 and installation of capital facilities, costs of planning, 12 supplies, equipment, materials, services, and all other 13 expenses required to complete the work. This appropriation 14 shall be in addition to any other appropriated amounts which 15 can be expended for these purposes. 16 Section 10G. The amount of $1,009,995, or so much 17 thereof as may be necessary, and remains unexpended on June 18 30, 2002 from appropriations heretofore made for such 19 purposes in Article 57, Division FY91, Section 10G of Public 20 Act 92-8, as amended, is reappropriated from the Build 21 Illinois Bond Fund to the Capital Development Board for the 22 Illinois Community College Board for grants to community 23 colleges repair, renovation, and miscellaneous capital 24 improvements including construction, reconstruction, 25 remodeling, improvement, repair and installation of capital 26 facilities, costs of planning, supplies, equipment, 27 materials, services, and all other expenses required to 28 complete the work. This appropriation shall be in addition 29 to any other appropriated amounts which can be expended for 30 these purposes. 31 Division 9999. This Division contains provisions -73- BOB-BI03 1 governing the expenditure of funds appropriated in these 2 Articles. 3 No contract shall be entered into or obligation incurred 4 for any expenditures from the appropriations made in this 5 Article until after the purposes and amounts have been 6 approved in writing by the Governor. 7 Section 99. Effective date. This Act takes effect on 8 July 1, 2002.
