92_SB2311 LRB9215831SMdv 1 AN ACT concerning attorney licenses. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Attorney Discipline for Nonpayment of Taxes Act. 6 Section 5. Intent. It is the intent of the General 7 Assembly to impose a penalty upon attorneys licensed in 8 Illinois who fail to fully and timely meet their obligation 9 to pay taxes owed to the State of Illinois. The General 10 Assembly authorizes disciplinary action to be taken against 11 other professionals in Illinois for the nonpayment of taxes. 12 In an effort to treat the members of each profession in a 13 like manner, the General Assembly, in this Act, extends this 14 treatment to attorneys licensed in Illinois. 15 Section 10. Discipline for failing to meet tax 16 obligations. The Illinois Supreme Court shall direct the 17 Attorney Registration and Disciplinary Commission to impose 18 discipline upon an attorney licensed to practice law in 19 Illinois for failure to file a return, to pay the tax, 20 penalty, or interest shown in a filed return, or to pay any 21 final assessment of tax, penalty, or interest, as required by 22 any tax Act administered by the Illinois Department of 23 Revenue or any successor agency. The discipline shall be 24 determined by the Attorney Registration and Disciplinary 25 Commission and shall include disbarment in cases warranting 26 it. 27 Section 99. Effective date. This Act takes effect upon 28 becoming law.
