92_SB2206 LRB9213173ACcd 1 AN ACT concerning the Department of Professional 2 Regulation. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Department of Professional Regulation Law 6 of the Civil Administrative Code of Illinois is amended by 7 adding Section 2105-60 as follows: 8 (20 ILCS 2105/2105-60 new) 9 Sec. 2105-60. Payment by credit card or third-party 10 payment agent. 11 (a) For the purposes of this Section, "credit card" has 12 the meaning given to it in Section 10 of the Local Government 13 Acceptance of Credit Cards Act. 14 (b) The Department may, but need not, accept payment by 15 credit card for any fee, fine, or other charge that it is 16 authorized by law to collect. The Department may adopt rules 17 and procedures governing the acceptance of payment by credit 18 card and may enter into such agreements as may be necessary 19 to accept payment by credit card. 20 (c) The Department may, but need not, accept payment 21 through a third-party payment agent of any fee, fine, or 22 other charges to the Department. The Department may adopt 23 rules and procedures governing the acceptance of payments 24 through third-party payment agents. 25 The Department may enter into agreements with one or more 26 financial institutions, internet companies, or other business 27 entities to act as third-party payment agents for the payment 28 of fees, fines, or other charges to the Department. These 29 agreements may authorize the third-party payment agent to 30 retain a service fee out of the payments collected. 31 (d) Receipt by the Department of the amount of a fee, -2- LRB9213173ACcd 1 fine, or other charge paid by credit card or through a 2 third-party payment agent authorized by the Department, less 3 the amount of any service fee retained under the Department's 4 agreement with the credit card service provider or the 5 third-party payment agent, shall be deemed receipt of the 6 full amount of the fee or other charge and shall discharge 7 the payment obligation in full. 8 (e) In the event of a conflict between this Section and 9 a provision of any other Act administered by the Department, 10 this Section controls. 11 Section 99. Effective date. This Act takes effect upon 12 becoming law.
