92_SB2188 LRB9211251JSpc 1 AN ACT concerning the Office of Banks and Real Estate. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Office of Banks and Real Estate Act is 5 amended by adding Section 5.5 as follows: 6 (20 ILCS 3205/5.5 new) 7 Sec. 5.5. Payment by credit card or third-party payment 8 agent. 9 (a) For the purposes of this Section, the term "credit 10 card" has the meaning given in Section 10 of the Local 11 Governmental Acceptance of Credit Cards Act. 12 (b) The Office may, but need not, accept payment by 13 credit card for any fee, fine, or other charge that it is 14 authorized by law to collect. The Office may adopt rules and 15 procedures governing the acceptance of payment by credit card 16 and may enter into such agreements as may be necessary to 17 accept payment by credit card. 18 (c) The Office may enter into agreements with one or 19 more financial institutions, internet companies, or other 20 business entities to act as third-party payment agents for 21 the payment of fees, fines, or other charges to the Office. 22 These agreements may authorize the third-party payment agent 23 to retain a service fee out of the payments collected. 24 The Office may, but need not, accept payment through a 25 third-party payment agent of any fee, fine, or other charge 26 that it is authorized by law to collect. The Office may 27 adopt rules and procedures governing the acceptance of 28 payments through third-party payment agents. 29 (d) Receipt by the Office of the amount of a fee, fine, 30 or other charge paid by credit card or through a third-party 31 payment agent authorized by the Office, less the amount of -2- LRB9211251JSpc 1 any service fee retained under the Office's agreement with 2 the credit card service provider or third-party payment 3 agent, shall be deemed receipt of the full amount of the fee 4 or other charge and shall discharge the payment obligation in 5 full. 6 (e) In the event of a conflict between this Section and 7 a provision of any other Act administered by the Office, this 8 Section controls. 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.
