1 AN ACT concerning energy savings contracts.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Local Government Energy Conservation Act
5 is amended by changing Section 20 as follows:
6 (50 ILCS 515/20)
7 Sec. 20. Guarantee. The guaranteed energy savings
8 contract shall include a written guarantee of the qualified
9 provider that either the energy or operational cost savings,
10 or both, will meet or exceed within 20 10 years the costs of
11 the energy conservation measures. The qualified provider
12 shall reimburse the unit of local government for any
13 shortfall of guaranteed energy savings projected in the
14 contract. A qualified provider shall provide a sufficient
15 bond to the unit of local government for the installation and
16 the faithful performance of all the measures included in the
17 contract. The guaranteed energy savings contract may provide
18 for payments over a period of time, not to exceed 20 10 years
19 from the date of the final installation of the measures.

21 Section 10. The School Code is amended by changing
22 Section 19b-4 as follows:
23 (105 ILCS 5/19b-4) (from Ch. 122, par. 19b-4)
24 Sec. 19b-4. Guarantee. The guaranteed energy savings
25 contract shall include a written guarantee of the qualified
26 provider that either the energy or operational cost savings,
27 or both, will meet or exceed within 20 10 years the costs of
28 the energy conservation measures. The qualified provider
29 shall reimburse the school district for any shortfall of

1 guaranteed energy savings projected in the contract. A
2 qualified provider shall provide a sufficient bond to the
3 school district for the installation and the faithful
4 performance of all the measures included in the contract.
5 The guaranteed energy savings contract may provide for
6 payments over a period of time, not to exceed 20 10 years
7 from the date of final installation of the measures.

10 Section 15. The School Code is amended by repealing
11 Section 19b-10.
12 Section 99. Effective date. This Act takes effect upon
13 becoming law.
