 1        AN ACT in relation to bicycle safety.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Vehicle  Code  is amended by
 5    changing Section 11-1502 as follows:

 6        (625 ILCS 5/11-1502) (from Ch. 95 1/2, par. 11-1502)
 7        Sec. 11-1502.  (a) Traffic laws apply to  persons  riding
 8    bicycles.  Every person riding a bicycle upon a highway shall
 9    be  granted  all of the rights and shall be subject to all of
10    the duties applicable to the driver  of  a  vehicle  by  this
11    Code, except as to special regulations in this Article XV and
12    except  as  to  those  provisions of this Code which by their
13    nature can have no application.
14        (b)  A  person  riding  a  bicycle  is  an  intended  and
15    permitted user of  any  highway  in  Illinois  except  for  a
16    highway on which bicycle use has been specifically prohibited
17    by  law  and  the  prohibition  is  indicated  by appropriate
18    signage.

20        Section 10.   The  Local  Governmental  and  Governmental
21    Employees  Tort  Immunity  Act  is  amended by adding Section
22    3-111 as follows:

23        (745 ILCS 10/3-111 new)
24        Sec. 3-111. Bicyclists using bike  lanes  and  designated
25    shoulders  on  highways.  Neither a local public entity nor a
26    public employee is liable for any injury to a bicyclist  when
27    the  liability  is based on the existence of a condition of a
28    bike lane or shoulder on a segment or portion  of  a  highway
29    that  has been designated with appropriate signs and pavement

 1    markings for bicycle use unless the local  public  entity  or
 2    public  employee  is  guilty of willful and wanton misconduct
 3    proximately causing the injury.
