Amend Senate Bill 1806 on page 17, 3 below line 28, by inserting the following: 4 "This Section does not prohibit the use of a euthanasia 5 drug by a euthanasia agency for the purpose of animal 6 euthanasia, provided that the euthanasia drug is used by or 7 under the direction of a licensed veterinarian or certified 8 euthanasia technician, all as defined in and subject to the 9 Humane Euthanasia in Animal Shelters Act."; and 10 on page 33, by replacing lines 7 through 9 with the 11 following: 12 "Sec. 26-5. Dog fighting. (For other provisions that may 13 apply to dog fighting, see the Humane Care for Animals Act. 14 For provisions similar to this Section that apply to animals 15 other than dogs, see in particular Section 4.01 of the Humane 16 Care for Animals Act.)"; and 17 on page 36, below line 5, by inserting the following: 18 "(j) Any dog or equipment involved in a violation of 19 this Section shall be immediately seized and impounded under 20 Section 12 of the Humane Care for Animals Act when located at 21 any show, exhibition, program, or other activity featuring or 22 otherwise involving a dog fight for the purposes of sport, 23 wagering, or entertainment. -2- LRB9211445EGfgam02 1 (k) Any vehicle or conveyance other than a common 2 carrier that is used in violation of this Section shall be 3 seized, held, and offered for sale at public auction by the 4 sheriff's department of the proper jurisdiction, and the 5 proceeds from the sale shall be remitted to the general fund 6 of the county where the violation took place. 7 (l) Any veterinarian in this State who is presented with 8 a dog for treatment of injuries or wounds resulting from 9 fighting where there is a reasonable possibility that the dog 10 was engaged in or utilized for a fighting event for the 11 purposes of sport, wagering, or entertainment shall file a 12 report with the Department of Agriculture and cooperate by 13 furnishing the owners' names, dates, and descriptions of the 14 dog or dogs involved. Any veterinarian who in good faith 15 complies with the requirements of this subsection has 16 immunity from any liability, civil, criminal, or otherwise, 17 that may result from his or her actions. For the purposes of 18 any proceedings, civil or criminal, the good faith of the 19 veterinarian shall be rebuttably presumed. 20 (m) In addition to any other penalty provided by law, 21 upon conviction for violating this Section, the court may 22 order that the convicted person and persons dwelling in the 23 same household as the convicted person who conspired, aided, 24 or abetted in the unlawful act that was the basis of the 25 conviction, or who knew or should have known of the unlawful 26 act, may not own, harbor, or have custody or control of any 27 dog or other animal for a period of time that the court deems 28 reasonable.".
