92_SB1764 LRB9215494BDdv 1 AN ACT concerning the Regional Transportation Authority. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Regional Transportation Authority Act is 5 amended by changing Sections 3.01 and 3B.02 as follows: 6 (70 ILCS 3615/3.01) (from Ch. 111 2/3, par. 703.01) 7 Sec. 3.01. Board of Directors. Upon expiration of the 8 term of the members of the Transition Board as provided for 9 in Section 3.09, the corporate authorities and governing body 10 of the Authority shall be a Board consisting of 13 Directors 11 appointed as follows: 12 (a) Four Directors appointed by the Mayor of the City of 13 Chicago, with the advice and consent of the City Council of 14 the City of Chicago, and a fifth director who shall be the 15 Chairman of the Chicago Transit Authority. Each of these 16 Directors mustsuch Director shallreside in the City of 17 Chicago except the Chairman of the Chicago Transit Authority 18 who mustshallreside within the metropolitan area as defined 19 in the Metropolitan Transit Authority Act. 20 (b) Four Directors appointed by the members of the Cook 21 County Board elected from that part of Cook County outside of 22 Chicago, or, in the event thesuchBoard of Commissioners 23 becomes elected from single member districts, by those 24 Commissioners elected from districts, a majority of the 25 electors of which reside outside Chicago. In either case, 26 thesuchappointment mustshallbe with the concurrence of 27 four such Commissioners. Each of these Directors mustsuch28Director shallreside in that part of Cook County outside 29 Chicago. 30 (c) Two Directors appointed by the Chairmen of the 31 county boards of Kane, Lake, McHenry, and Will Counties, with -2- LRB9215494BDdv 1 the concurrence of not less than a majority of the Chairmen 2 from thesesuchcounties, from nominees by the Chairmen. Each 3suchChairman may nominate not more than 2 persons for each 4 position. Each of these Directors mustsuch Director shall5 reside in a county in the metropolitan region other than Cook 6 or DuPage Counties. 7 (d) One Director shall be appointed by the Chairman of 8 the Board of DuPage County with the advice and consent of the 9 County Board of DuPage County and mustshallreside in DuPage 10 County. 11 (e) Before January 1, 1987, for the term expiring July 12 1, 1989, the Chairman shall be appointed by the Governor. 13 Thereafter the Chairman shall be appointed by the other 12 14 Directors with the concurrence of three-fourths of thesuch15 Directors. The chairman mayshallnot be appointed from among 16 the other Directors. The chairman mustshallbe a resident of 17 the metropolitan region. 18 (f) Except as otherwise provided by this Act no Director 19 mayshall, while serving as such, be an officer, a member of 20 the Board of Directors or Trustees or an employee of any 21 transportation agency, or be an employee of the State of 22 Illinois or any department or agency thereof, or of any unit 23 of local government or receive any compensation from any 24 elected or appointed office under the Constitution and laws 25 of Illinois; except that a Director may be a member of a 26 school board. 27 (g) Each appointment made under this Section and under 28 Section 3.03 shall be certified by the appointing authority 29 to the Board, which shall maintain the certifications as part 30 of the official records of the Authority; provided that the 31 initial appointments shall be certified to the Secretary of 32 State, who shall transmit the certifications to the Board 33 following its organization. All appointments made by the 34 Governor shall be made with the advice and consent of the -3- LRB9215494BDdv 1 Senate. 2 (h) The Board of Directors shall be so appointed as to 3 represent the City of Chicago, that part of Cook County 4 outside the City of Chicago, and that part of the 5 metropolitan region outside Cook County on the one man one 6 vote basis. After each Federal decennial census the General 7 Assembly shall review the composition of the Board and, if a 8 change is needed to comply with this requirement, shall 9 provide for the necessary revision by July 1 of the third 10 year after such census. Provided, however, that the Chairman 11 of the Chicago Transit Authority shall be a Director of the 12 Authority and shall be considered as representing the City of 13 Chicago for purposes of this paragraph. 14 Insofar as may be practicable, the changes in Board 15 membership necessary to achieve this purpose shall take 16 effect as appropriate members terms expire, no member's term 17 being reduced by reason of such revision of the composition 18 of the Board. 19 (Source: P.A. 83-1417.) 20 (70 ILCS 3615/3B.02) (from Ch. 111 2/3, par. 703B.02) 21 Sec. 3B.02. Commuter Rail Board. The governing body of 22 the Commuter Rail Division shall be a board consisting of 7 23 directors appointed pursuant to Sections 3B.03 and 3B.04, as 24 follows: 25 (a) One director shall be appointed by the Chairman of 26 the Board of DuPage County with the advice and consent of the 27 County Board of DuPage County and mustshallreside in DuPage 28 County; 29 (b) Two directors appointed by the Chairmen of the 30 County Boards of Kane, Lake, McHenry, and Will Counties with 31 the concurrence of not less than a majority of the chairmen 32 from thesesuchcounties, from nominees by the Chairmen. 33 Eachsuchchairman may nominate not more than two persons for -4- LRB9215494BDdv 1 each position. Each of these directors mustsuch director2shallreside in a county in the metropolitan region other 3 than Cook or DuPage County. 4 (c) Three directors appointed by the members of the Cook 5 County Board elected from that part of Cook County outside of 6 Chicago, or, in the event such Board of Commissioners becomes 7 elected from single member districts, by those Commissioners 8 elected from districts, a majority of the residents of which 9 reside outside Chicago. In either case, such appointment 10 shall be with the concurrence of four such Commissioners. 11 Each such director shall reside in that part of Cook County 12 outside Chicago. 13 (d) One director appointed by the Mayor of the City of 14 Chicago, with the advice and consent of the City Council of 15 the City of Chicago. Such director shall reside in the City 16 of Chicago. 17 The chairman shall be appointed by the directors, from 18 the members of the board, with the concurrence of 5 of such 19 directors. 20 No director, while serving as such, shall be an officer, 21 a member of the board of directors or trustee or an employee 22 of any transportation agency, or be an employee of the State 23 of Illinois or any department or agency thereof, or of any 24 unit of local government or receive any compensation from any 25 elected or appointed office under the Constitution and laws 26 of Illinois. 27 Each appointment made under paragraphs (a) through (d) 28 and under Section 3B.03 shall be certified by the appointing 29 authority to the Commuter Rail Board which shall maintain the 30 certifications as part of the official records of the 31 Commuter Rail Board; provided that the initial appointments 32 shall be certified to the Secretary of State, who shall 33 transmit the certifications to the Commuter Rail Board 34 following its organization. -5- LRB9215494BDdv 1 Appointments to the Commuter Rail Board shall be 2 apportioned so as to represent the City of Chicago, that part 3 of Cook County outside of the City of Chicago, and DuPage 4 County and that part of the metropolitan region other than 5 Cook and DuPage Counties based on morning boardings of the 6 services provided by the Commuter Rail Division as certified 7 to the Board of the Authority by the Commuter Rail Board, 8 provided however that the Mayor of the City of Chicago shall 9 appoint no fewer than 1 member of the Commuter Rail Board. 10 Within two years after each federal decennial census, the 11 Board of the Authority shall review the composition of the 12 Commuter Rail Board and, if change is needed to comply with 13 this requirement, shall provide for the necessary 14 reapportionment by July 1 of the second year after such 15 census. Insofar as may be practicable, the changes in board 16 membership necessary to achieve this purpose shall take 17 effect as appropriate members terms expire, no member's term 18 being reduced by reason of such revision of the composition 19 of the Commuter Rail Board. 20 (Source: P.A. 83-886.)
