92_SB1729 LRB9214245DHgc 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 adding Section 6-205.2, as follows: 6 (625 ILCS 5/6-205.2 new) 7 Sec. 6-205.2. Mandatory revocation of license or permit 8 pending court disposition. 9 (a) Within 72 hours of charging any person with reckless 10 homicide resulting from the operation of a motor vehicle, the 11 State's Attorney must notify the Secretary of State of those 12 charges. 13 (b) The Secretary, upon receiving notification from the 14 State's Attorney, must revoke the driver's license of the 15 person against whom the charges are pending. 16 (c) The State's Attorney must notify the Secretary of 17 the final disposition of the case of any person who has been 18 denied a driver's license under subsection (b). If the 19 individual whose driving privileges have been revoked under 20 this Section is adjudicated guilty, the revocation previously 21 entered must remain in effect. If the individual whose 22 driving privileges have been revoked under this Section is 23 adjudicated not guilty, the revocation previously entered 24 must be rescinded.
