Amend Senate Bill 1726 as follows: 3 on page 1, line 5, by replacing "Section" with "Sections 4 6-301 and"; and 5 on page 1, by inserting between lines 5 and 6 the following: 6 "(625 ILCS 5/6-301) (from Ch. 95 1/2, par. 6-301) 7 Sec. 6-301. Unlawful use of license or permit. 8 (a) It is a violation of this Section for any person: 9 1. To display or cause to be displayed or have in 10 his possession any cancelled, revoked or suspended 11 license or permit; 12 2. To lend his license or permit to any other 13 person or knowingly allow the use thereof by another; 14 3. To display or represent as his own any license 15 or permit issued to another; 16 4. To fail or refuse to surrender to the Secretary 17 of State or his agent or any peace officer upon his 18 lawful demand, any license or permit, which has been 19 suspended, revoked or cancelled; 20 5. To allow any unlawful use of a license or permit 21 issued to him; 22 6. To submit to an examination or to obtain the -2- LRB9212654RCcdam 1 services of another person to submit to an examination 2 for the purpose of obtaining a drivers license or permit 3 for some other person. 4 (b) Sentence. 5 1. Any person convicted of a violation of this 6 Section shall be guilty of a Class A misdemeanor and 7 shall be sentenced to a minimum fine of $500 or 50 hours 8 of community service, preferably at an alcohol abuse 9 prevention program, if available. 10 2. Any person convicted of a second or subsequent 11 violation of this Section shall be guilty of a Class 4 12 felony. 13 3. In addition to any other sentence imposed under 14 paragraph 1 or 2 of this subsection (b), a person 15 convicted of a violation of paragraph 6 of subsection (a) 16 shall be imprisoned for not less than 7 days. 17 (c) This Section does not prohibit any lawfully 18 authorized investigative, protective, law enforcement or 19 other activity of any agency of the United States, State of 20 Illinois or any other state or political subdivision thereof. 21 (d) This Section does not apply to licenses and permits 22 invalidated under Section 6-301.3 of this Code. 23 (Source: P.A. 88-197; 88-210; 88-670, eff. 12-2-94.)"; and 24 on page 2, by replacing lines 9 through 11 with the 25 following: 26 "Any person convicted of a violation of subsection 6 of27Section 6-301 shall be guilty of a Class C misdemeanor and28shall be imprisoned for not less than 7 days.".
