92_SB1713 LRB9212377JSpc 1 AN ACT concerning temporary checks. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Check Printer and Check Number Act is 5 amended by changing Sections 30 and 36 and adding Section 12 6 as follows: 7 (205 ILCS 690/12 new) 8 Sec. 12. Distribution of temporary checks. A financial 9 institution may not authorize the distribution of temporary 10 checks pursuant to a request made by telephone. A financial 11 institution may distribute temporary checks only to an 12 account holder and only after the account holder provides 13 written documentation of the account number. 14 (205 ILCS 690/30) 15 Sec. 30. Civil action. 16 (a) When the Commissioner believes a person has 17 violated, is violating, or will violate this Act or a rule 18 prescribed under this Act, the Commissioner may request the 19 Attorney General to bring a civil action in circuit court to 20 enjoin the violation or enforce compliance with this Act or a 21 rule prescribed under this Act. A person not complying with 22 an injunction issued under this Section is liable to the 23 State of Illinois in a civil suit for an amount of not more 24 than $10,000. 25 (b) If the Commissioner finds that any person has 26 violated SectionSections10, 12, 20, 21, or 25 of this Act, 27 or any rules adopted by the Commissioner under this Act, the 28 Commissioner may, in addition to seeking an injunction as 29 provided in subsection (a) of this Section, impose a civil 30 monetary penalty in an amount of not more than $10,000 for -2- LRB9212377JSpc 1 each violation. 2 (Source: P.A. 90-184, eff. 7-23-97; 90-575, eff. 3-20-98; 3 90-655, eff. 7-30-98.) 4 (205 ILCS 690/36) 5 Sec. 36. Criminal penalties. 6 (a) A person who willfully and knowingly subscribes to 7 or makes, or causes to be made, any false statement on the 8 registration form with intent to deceive the Commissioner or 9 his administrative officers shall, upon conviction thereof, 10 be guilty of a Class 3 felony. 11 (b) A person who knowingly violates Section 12 of this 12 Act is guilty of a Class A misdemeanor. 13 (Source: P.A. 90-184, eff. 7-23-97.)
