92_SB1683 LRB9212593EGfg 1 AN ACT in relation to the Metropolitan Water Reclamation 2 District. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Metropolitan Water Reclamation District 6 Act is amended by changing Section 4.32 as follows: 7 (70 ILCS 2605/4.32) (from Ch. 42, par. 323.32) 8 Sec. 4.32. Veteran's preference. 9 (a) A person who served on active duty in the United 10 States Army, Navy, Air Force, Marine Corps, or Coast Guard 11 for a period of more than 180 consecutive days and was 12 honorably discharged from that service is entitled to a 13 veteran's preference under this Section. 14 For the purpose of this Section, "active duty" does not 15 include training or inactive duty performed as a member of 16 the National Guard or a Reserve component of the armed 17 forces. 18 (b) The Director of Personnel shall give preference for 19 promotional appointment to a person qualifying for a 20 veteran's preference under this Section whose name appears on 21 a promotional eligible register by adding 5 points to the 22 final grade that the person receives as the result of any 23 promotional examination held on or after the effective date 24 of this amendatory Act of the 92nd General Assembly. 25 (c) The changes made to this Section by this amendatory 26 Act of the 92nd General Assembly are not intended to affect 27 any preference granted under this Section before the 28 effective date of this amendatory Act. 29Persons who were engaged in the military or naval service30of the United States during the years 1898, 1899, 1900, 1901,311902, 1914, 1915, 1916, 1917, 1918, or 1919, any time between-2- LRB9212593EGfg 1September 16, 1940 and July 25, 1947, or any time during the2national emergency between June 25, 1950 and January 31,31955, and who were honorably discharged therefrom, and all4persons who were engaged in such military or naval service5during any of said years, any time between September 16, 19406and July 25, 1947, or any time during the national emergency7between June 25, 1950 and January 31, 1955, or any time from8August 5, 1964 until the date determined by the Congress of9the United States as the end of Viet Nam hostilities, or at10any time between August 6, 1990 and the date the Persian Gulf11Conflict ends as prescribed by Presidential proclamation or12order, who are now or may hereafter be on inactive or reserve13duty in such military or naval service, not including,14however, persons who were convicted by court-martial of15disobedience of orders, where such disobedience consisted in16the refusal to perform military service on the ground of17alleged religious or conscientious objections against war,18shall be preferred for appointments to offices, positions and19places of employment in the classified service of the20District, provided they are found to possess the business21capacity necessary for the proper discharge of the duties of22such office, position, or place of employment as determined23by examination for original entrance. The Director of24Personnel on certifying from any existing register of25eligibles resulting from the holding of an examination for26original entrance or any register of eligibles that may be27hereafter created of persons who have taken and successfully28passed the examinations provided for in this Act for original29entrance commenced prior to September 1, 1949, shall place30the name or names of such persons at the head of any existing31eligible register or list of eligibles that shall be created32under the provisions of this Act to be certified for33appointment. The Director of Personnel shall give preference34for original appointment to persons as hereinabove designated-3- LRB9212593EGfg 1whose names appear on any register of eligibles resulting2from an examination for original entrance held under the3provisions of this Act and commenced on or after September 1,41949 by adding to the final grade average which they received5or will receive as the result of any examination held for6original entrance, five points. The numerical result thus7attained shall be applied by the Director of Personnel in8determining the position of such persons on any eligible list9which has been created as the result of any examination for10original entrance commenced on or after September 1, 1949 for11purposes of preference in certification and appointment from12such eligible list.13Every certified Civil Service employee who was called to,14or who volunteered for, the military or naval service of the15United States at any time during the years specified in this16Act, or at any time between September 16, 1940 and July 25,171947 or any time during the national emergency between June1825, 1950 and January 31, 1955, or any time from August 5,191964 until the date determined by Congress of the United20States as the end of Viet Nam hostilities, or at any time21between August 6, 1990 and the date the Persian Gulf conflict22ends as prescribed by Presidential proclamation or order, and23who were honorably discharged therefrom or who are now or who24may hereafter be on inactive or reserve duty in such military25or naval service, not including, however, persons who were26convicted by court martial of disobedience of orders where27such disobedience consisted in the refusal to perform28military service on the ground of alleged religious or29conscientious objections against war, and whose names appear30on existing promotional eligible registers or any promotional31eligible register that may hereafter be created, as provided32for by this Act, shall be preferred for promotional33appointment to civil offices, positions and places of34employment in the classified civil service of the District-4- LRB9212593EGfg 1coming under the provisions of this Act.2The Director of Personnel shall give preference for3promotional appointment to persons as hereinabove designated4whose names appear on existing promotional eligible registers5or promotional eligible registers that may hereafter be6created by adding to the final grade average which they7received or will receive as the result of any promotional8examination commencing prior to September 1, 19499three-fourths of one point for each 6 months or fraction10thereof of military or naval service not exceeding 48 months,11and by adding to the final grade average which they will12receive as the result of any promotional examination held13commencing on or after September 1, 1949 seven-tenths of one14point for each 6 months or fraction thereof of military or15naval service not exceeding 30 months. The numerical result16thus attained shall be applied by the Director of Personnel17in determining the position of such persons on any eligible18list which has been created or will be created as the result19of any promotional examination held hereunder for purposes of20preference in certification and appointment from such21eligible list.22No person shall receive the preference for a promotional23appointment granted by this Section after he has received one24promotion from an eligible list on which he was allowed such25preference and which was prepared as a result of an26examination held on or after September 1, 1949.27No person entitled to preference or credit for military28or naval service hereunder shall be required to furnish29evidence or record of honorable discharge from the armed30forces before any examination held under the provisions of31this Act but such preference shall be given after the posting32or publication of the eligible list or register and before33any certification or appointments are made from the eligible34register.-5- LRB9212593EGfg 1 (Source: P.A. 86-324; 87-945.) 2 Section 99. Effective date. This Act takes effect on 3 January 1, 2003.
