92_SB1645eng SB1645 Engrossed LRB9212300LBpr 1 AN ACT concerning energy efficiency. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Renewable Energy, Energy Efficiency, and 5 Coal Resources Development Law of 1997 is amended by changing 6 Section 6-6 as follows: 7 (20 ILCS 687/6-6) 8 (Section scheduled to be repealed on December 16, 2007) 9 Sec. 6-6. Energy efficiency program. 10 (a) For the year beginning January 1, 1998, and 11 thereafter as provided in this Section, each electric utility 12 as defined in Section 3-105 of the Public Utilities Act and 13 each alternative retail electric supplier as defined in 14 Section 16-102 of the Public Utilities Act supplying electric 15 power and energy to retail customers located in the State of 16 Illinois shall contribute annually a pro rata share of a 17 total amount of $3,000,000 based upon the number of 18 kilowatt-hours sold by each such entity in the 12 months 19 preceding the year of contribution. On or before May 1 of 20 each year, the Illinois Commerce Commission shall determine 21 and notify the Department of Commerce and Community Affairs 22 of the pro rata share owed by each electric utility and each 23 alternative retail electric supplier based upon information 24 supplied annually to the Illinois Commerce Commission. On or 25 before June 1 of each year, the Department of Commerce and 26 Community Affairs shall send written notification to each 27 electric utility and each alternative retail electric 28 supplier of the amount of pro rata share they owe. These 29 contributions shall be remitted to the Department of Revenue 30 on or before June 30 of each year the contribution is due on 31 a return prescribed and furnished by the Department of SB1645 Engrossed -2- LRB9212300LBpr 1 Revenue showing such information as the Department of Revenue 2 may reasonably require. The funds received pursuant to this 3 Section shall be subject to the appropriation of funds by the 4 General Assembly. The Department of Revenue shall place the 5 funds remitted under this Section in a trust fund, that is 6 hereby created in the State Treasury, called the Energy 7 Efficiency Trust Fund. If an electric utility or alternative 8 retail electric supplier does not remit its pro rata share to 9 the Department of Revenue, the Department of Revenue must 10 inform the Illinois Commerce Commission of such failure. The 11 Illinois Commerce Commission may then revoke the 12 certification of that electric utility or alternative retail 13 electric supplier. The Illinois Commerce Commission may not 14 renew the certification of any electric utility or 15 alternative retail electric supplier that is delinquent in 16 paying its pro rata share. 17 (b) The Department of Commerce and Community Affairs 18 shall disburse the moneys in the Energy Efficiency Trust Fund 19 to benefit residential electric customers throughto fund20 projects which the Department of Commerce and Community 21 Affairs has determined will promote energy efficiency in the 22 State of Illinois. The Department of Commerce and Community 23 Affairs shall establish a list of projects eligible for 24 grants from the Energy Efficiency Trust Fund including, but 25 not limited to, supporting energy efficiency efforts for 26 low-income households, replacing energy inefficient windows 27 with more efficient windows, replacing energy inefficient 28 appliances with more efficient appliances, replacing energy 29 inefficient lighting with more efficient lighting, insulating 30 dwellings and buildings, using market incentives to encourage 31 energy efficiency, and such other projects which will 32 increase energy efficiency in homes and rental properties. 33 (c) The Department of Commerce and Community Affairs 34 shall establish criteria and an application process for this SB1645 Engrossed -3- LRB9212300LBpr 1 grant program. 2 (d) The Department of Commerce and Community Affairs 3 shall conduct a study of other possible energy efficiency 4 improvements and evaluate methods for promoting energy 5 efficiency and conservation, especially for the benefit of 6 low-income customers. 7 (e) The Department of Commerce and Community Affairs 8 shall submit an annual report to the General Assembly 9 evaluating the effectiveness of the projects and programs 10 provided in this Section, and recommending further 11 legislation which will encourage additional development and 12 implementation of energy efficiency projects and programs in 13 Illinois and other actions that help to meet the goals of 14 this Section. 15 (Source: P.A. 90-561, eff. 12-16-97; 90-624, eff. 7-10-98.) 16 Section 99. Effective date. This Act takes effect upon 17 becoming law.
