92_SB1572 LRB9212687DHgc 1 AN ACT concerning vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Sections 1-171, 3-412, 3-413, 3-602, 3-606, 3-610, 6 3-620, 3-629, 3-806.1, 3-806.2, 3-806.4, 3-810, 3-810.1, 7 3-820, 5-201, and 5-202 as follows: 8 (625 ILCS 5/1-171) (from Ch. 95 1/2, par. 1-171) 9 Sec. 1-171. Registration - Registration Sticker. 10 Registration. The registration certificate or certificates, 11 registration plates and registration stickers issued under 12 the laws of this State pertaining to the registration of 13 vehicles. 14 Registration Sticker or Stickers. A device or devices to 15 be attached to arearregistration plate that will renew the 16 registration and registration plateor platesfor a 17 pre-determined period not to exceed one registration year 18 except as provided in subsection (1) of Section 3-414 of this 19 Code. 20 On and after the effective date of this amendatory Act of 21 the 92nd General Assembly, any reference to "registration 22 plates", "license plates", or "plates" in the plural number 23 in any law or rule shall be deemed to be a reference to the 24 single registration plate required to be furnished and 25 displayed in accordance with this amendatory Act of the 92nd 26 General Assembly.Should the Secretary of State determine it27is advisable to require a registration sticker to be attached28to a front registration plate, he may require such action and29provide the necessary additional sticker. Such determination30shall be publicly announced at least 30 days in advance of a31new annual registration year.-2- LRB9212687DHgc 1 (Source: P.A. 80-1185.) 2 (625 ILCS 5/3-412) (from Ch. 95 1/2, par. 3-412) 3 Sec. 3-412. Registration plates and registration 4 stickers to be furnished by the Secretary of State. 5 (a) The Secretary of State upon registering a vehicle 6 subject to annual registration for the first time shall 7 issue or shall cause to be issued to the owner one 8 registration platefor a motorcycle, trailer, semitrailer,9motorized pedalcycle or truck-tractor, 2 registration plates10for other motor vehiclesand, where applicable, current 11 registration stickers for motor vehicles of the first 12 division. The provisions of this Section may be made 13 applicable to such vehicles of the second division, as the 14 Secretary of State may, from time to time, in his discretion 15 designate. On subsequent annual registrations during the term 16 of the registration plate as provided in Section 3-414.1, the 17 Secretary shall issue or cause to be issued registration 18 stickers as evidence of current registration. However, the 19 issuance of annual registration stickers to vehicles 20 registered under the provisions of Section 3-402.1 of this 21 Code may not be required if the Secretary deems the issuance 22 unnecessary. 23 (b) Every registration plate shall have displayed upon 24 it the registration number assigned to the vehicle for which 25 it is issued, the name of this State, which may be 26 abbreviated, the year number for which it was issued, which 27 may be abbreviated, the phrase "Land of Lincoln",(except as 28 otherwise provided in this Code)Sections 3-626, 3-629,293-633, 3-634, 3-637, 3-638, and 3-642, and such other letters 30 or numbers as the Secretary may prescribe. However, for 31 apportionment plates issued to vehicles registered under 32 Section 3-402.1, the phrase "Land of Lincoln" may be omitted 33 to allow for the word "apportioned" to be displayed. The -3- LRB9212687DHgc 1 Secretary may in his discretion prescribe that letters be 2 used as prefixes only on registration plates issued to 3 vehicles of the first division which are registered under 4 this Code and only as suffixes on registration plates issued 5 to other vehicles. Every registration sticker issued as 6 evidence of current registration shall designate the year 7 number for which it is issued and such other letters or 8 numbers as the Secretary may prescribe and shall be of a 9 contrasting color with the registration plates and 10 registration stickers of the previous year. 11 (c) Each registration plate and the required letters and 12 numerals thereon, except the year number for which issued, 13 shall be of sufficient size to be plainly readable from a 14 distance of 100 feet during daylight, and shall be coated 15 with reflectorizing material. The dimensions of the plate 16 issued to vehicles of the first division shall be 6 by 12 17 inches. 18 (d) The Secretary of State shall issue for every 19 passenger motor vehicle rented without a driver the same type 20 of registration plates as the type of plates issued for a 21 private passenger vehicle. 22 (e) The Secretary of State shall issue for every 23 passenger car used as a taxicab or livery, distinctive 24 registration plates. 25 (f) The Secretary of State shall issue for every 26 motorcycle distinctive registration plates distinguishing 27 between motorcycles having 150 or more cubic centimeters 28 piston displacement, or having less than 150 cubic centimeter 29 piston displacement. 30 (g) Registration plates issued to vehicles for-hire may 31 display a designation as determined by the Secretary that 32 such vehicles are for-hire. 33 (h) The Secretary of State shall issue for each electric 34 vehicle distinctive registration plates which shall -4- LRB9212687DHgc 1 distinguish between electric vehicles having a maximum 2 operating speed of 45 miles per hour or more and those having 3 a maximum operating speed of less than 45 miles per hour. 4 (i) The Secretary of State shall issue for every public 5 and private ambulance registration plates identifying the 6 vehicle as an ambulance. The Secretary shall forward to the 7 Department of Public Aid registration information for the 8 purpose of verification of claims filed with the Department 9 by ambulance owners for payment for services to public 10 assistance recipients. 11 (j) The Secretary of State shall issue for every public 12 and private medical carrier or rescue vehicle livery 13 registration plates displaying numbers within ranges of 14 numbers reserved respectively for medical carriers and rescue 15 vehicles. Display of registration plates, registration 26 stickers and driveway decal permits. 27 (a) Registration plates issued for a motor vehicle other 28 than a motorcycle, trailer, semitrailer, truck-tractor, 29 apportioned bus, or apportioned truck shall be attached to 30thereto, one in the front and one inthe rear thereof. The 31 registration plate issued for a motorcycle, trailer or 32 semitrailer required to be registered hereunder and any 33 apportionment plate issued to a bus under the provisions of -5- LRB9212687DHgc 1 this Code shall be attached to the rear thereof. The 2 registration plate issued for a truck-tractor or an 3 apportioned truck required to be registered hereunder shall 4 be attached to the front thereof. 5 (b) Every registration plate shall at all times be 6 securely fastened in a horizontal position to the vehicle for 7 which it is issued so as to prevent the plate from swinging 8 and at a height of not less than 12 inches from the ground, 9 measuring from the bottom of such plate, in a place and 10 position to be clearly visible and shall be maintained in a 11 condition to be clearly legible, free from any materials that 12 would obstruct the visibility of the plate, including, but 13 not limited to, glass covers and tinted plastic covers. 14 Clear plastic covers are permissible as long as they remain 15 clear and do not obstruct the visibility of the plates. 16 Registration stickers issued as evidence of renewed annual 17 registration shall be attached to registration plates as 18 required by the Secretary of State, and be clearly visible at 19 all times. 20 (c) Every driveway decal permit issued pursuant to this 21 Code shall be firmly attached to the inside windshield of the 22 motor vehicle in such a manner that it cannot be removed 23 without being destroyed. If such decal permits are affixed 24 to a motor vehicle in any other manner the permit shall be 25 void and of no effect. 26 (d) The Illinois prorate decal issued to a foreign 27 registered vehicle part of a fleet prorated or apportioned 28 with Illinois, shall be displayed on a registration plate and 29 displayed on the front of such vehicle in the same manner as 30 an Illinois registration plate. 31 (e) The registration plate issued for a camper body 32 mounted on a truck displaying registration plates shall be 33 attached to the rear of the camper body. 34 (f) No person shall operate a vehicle, nor permit the -6- LRB9212687DHgc 1 operation of a vehicle, upon which is displayed an Illinois 2 registration plate, plates or registration stickers after the 3 termination of the registration period for which issued or 4 after the expiration date set pursuant to Sections 3-414 and 5 3-414.1 of this Code. 6 (Source: P.A. 89-245, eff. 1-1-96; 89-375, eff. 8-18-95.) 7 (625 ILCS 5/3-602) (from Ch. 95 1/2, par. 3-602) 8 Sec. 3-602. Certificate and special plates for dealers, 9 manufacturers, and transporters. 10 (a) Any dealer, manufacturer, or transporter may make 11 application to the Secretary of State upon the appropriate 12 form for a certificate containing a general distinguishing 13 number and for one or moresets ofspecial plates as 14 appropriate to various types of vehicles subject to 15 registration hereunder. The applicant shall submit such proof 16 of his or her status as a bona fide dealer, manufacturer, or 17 transporter as may be reasonably required by the Secretary of 18 State. 19 (b) The Secretary of State, upon granting any such 20 application, shall issue to the applicant a certificate 21 containing the applicant's name and address and special 22 plates as applied for. Both the certificates and special 23 plates shall display the general distinguishing number 24 assigned to the applicant. 25 (c) The Secretary of State shall issue special plates to 26 dealers and manufacturers in accordance with the following 27 formula: 28 number vehicles maximum numbersetsmaximum number 29 sold in previous of special plates additional plates 30 calendar year issued at fee setsetsissued at fee 31 by Sec. 3-810 set by Sec. 3-806 32 0 0 0 33 1-10 1 1 -7- LRB9212687DHgc 1 11-25 2 2 2 26-100 8 8 3 101-250 12 12 4 251-500 20 20 5 501-750 30 30 6 751-1000 40 40 7 1001-1500 50 50 8 1501-2000 60 60 9 2001-2500 70 70 10 2501+ 90 90 11 For those Dealers with annual sales over 2501, special 12 plates will be allocated based on 10sets ofplates under 13 each section for each additional 500 vehicles sold. 14 The limit on the maximum number of additional platessets15 issued to manufacturers at the fee set by Section 3-806 may 16 be lifted at the discretion of the Secretary of State. 17 The Secretary shall issue to a new dealer or manufacturer 18 not more than 8sets ofspecial plates at each fee. If the 19 new dealer or manufacturer has acquired his or her business 20 from a previous dealer or manufacturer, he or she may be 21 issued a number of platessetsbased upon the number of 22 vehicles sold in the previous calendar year by the previous 23 dealer or manufacturer. If the new dealer or manufacturer 24 was in business for only a part of the previous calendar 25 year, the number of special plates to which he or she is 26 entitled may be extrapolated from the number of vehicles he 27 or she sold during that part of the year. 28 (d) Any manufacturer of engine and driveline components 29 may apply to the Secretary of State for a license to operate 30 vehicles in which such components are installed on the public 31 highways of the State for the purpose of testing such 32 components. The application shall describe the components and 33 the vehicles in which they are installed, and shall contain 34 such additional information as the Secretary shall prescribe. -8- LRB9212687DHgc 1 Upon receipt of an application and an accompanying fee of 2 $1000, the Secretary shall issue to the applicant a license 3 for the entire test period of the components described in the 4 application. 5 Every licensee shall keep a record of each vehicle 6 operated under such license which shall be open to inspection 7 by the Secretary or his authorized representative for 8 inspection at any reasonable time during the day or night. 9 The license of a manufacturer of engine and driveline 10 components may be denied, revoked or suspended if the 11 Secretary finds that the manufacturer has: 12 (1) violated this Code; 13 (2) made any material misrepresentation to the 14 Secretary of State in connection with an application for 15 a license; or 16 (3) failed to produce for the Secretary of State 17 any record required to be produced by this Code. 18 This amendatory Act of 1983 shall be applicable to the 19 1984 registration year and thereafter. 20 (Source: P.A. 91-357, eff. 7-29-99.) 21 (625 ILCS 5/3-606) (from Ch. 95 1/2, par. 3-606) 22 Sec. 3-606. Members of General Assembly. Upon receipt of 23 a request of a member of the General Assembly, accompanied by 24 the appropriate application and fee, the Secretary of State 25 shall issue to the member a plate2 platesas described in 26 this Section. If the member so requests, the Secretary shall 27 issue 2 identicalsets of suchregistration plates for use on 28 2 different motor vehicles. A member may request that the 29 Secretary of State issue registration plates in the name of a 30 corporation when the corporation owns or leases the vehicle 31 to be registered and the member is an officer or director of 32 that corporation. Such registration plates shall be issued 33 for a 2-year period beginning January 1 of each odd-numbered -9- LRB9212687DHgc 1 year and ending December 31 of the subsequent even-numbered 2 year. If the application is from a member of the Senate, 3 there shall appear on therearplate, in addition to the 4 designation of the State and the year for which the license 5 was issued, the word "official" and appropriate wording or 6 abbreviation indicating that the holder is a member of the 7 Senate, followed by the number of the senatorial district of 8 the member.On the front plate, there shall appear9appropriate wording or abbreviation indicating that the10holder is a member of the Senate.If the application is from 11 a member of the House of Representatives, there shall appear 12 on therearplate, in addition to the designation of the 13 State and the year for which the license was issued, the word 14 "official" and appropriate wording or abbreviation indicating 15 that the holder is a member of the House of Representatives, 16 followed by the number assigned to the member.On the front17plate, there shall appear appropriate wording or abbreviation18indicating that the holder is a member of the House of19Representatives.Numbers 1 through 118 shall be assigned and 20 members with the longest length of service as members of the 21 legislature shall be given the lower numbers. 22 When members have an equal length of service, the lower 23 numbers shall be given in alphabetical order based on 24 surnames. 25 (Source: P.A. 88-661, eff. 9-16-94.) 26 (625 ILCS 5/3-610) (from Ch. 95 1/2, par. 3-610) 27 Sec. 3-610. Members of Congress. Upon receiving an 28 application for a certificate of registration for a motor 29 vehicle from a member of the Congress of the United States 30 from Illinois, accompanied with payments of the registration 31 fees and taxes required under this Act, the Secretary of 32 State instead of issuing to such member number plates as 33 hereinabove provided, shall, if such member so requests, -10- LRB9212687DHgc 1 issue to him two number plates as described in this Section. 2 Two duplicatesets of thesenumber plates may be issued if 3 requested and may be used on 2 different motor vehicles. 4 There shall appear, in addition to the designation of the 5 State and the year for which such license was issued, if he 6 is a member of the House of Representatives, the number of 7 the congressional district of such member in the center of 8 the plate followed in the next line by the words "U. S. 9 Congressman"; if he is the senior Senator from Illinois, the 10 number 1 shall be in the center of the plate followed in the 11 next line by the word "Senator"; and if he is the junior 12 Senator, the number 2 shall be in the center of the plate 13 followed in the next line by the word "Senator". 14 Such plates may be issued for a 2 year period beginning 15 January 1st of each odd-numbered year and ending December 16 31st of the subsequent even-numbered years. 17 (Source: P.A. 85-413.) 18 (625 ILCS 5/3-620) (from Ch. 95 1/2, par. 3-620) 19 Sec. 3-620. The Secretary, upon receipt of an 20 application made on the form prescribed by the Secretary of 21 State, may issue special registration plates to United 22 States citizens, who are present or former members of the 23 United States armed forces or any of its allies, and who were 24 prisoners of war of World War I, World War II, the Korean 25 Conflict, and the Vietnamese conflict, or to the widowed 26 spouse of a former member of the United States armed forces, 27 providing that widowed spouse was married to the POW at the 28 time of death, and is a single person at the time of 29 application. The special plates issued pursuant to this 30 Section shall be affixed only to passenger vehicles of the 31 first division subject to the staggered registration system 32 and vehicles of the second division having a gross weight of 33 8000 pounds or less and shall be issued without charge. Only -11- LRB9212687DHgc 1 one plateset of platesmay be issued at no fee. 2 The design and color of the prisoner of war plates shall 3 be wholly within the discretion of the Secretary of State. 4 (Source: P.A. 84-1308.) 5 (625 ILCS 5/3-629) 6 Sec. 3-629. Collegiate license plates; scholarship fund. 7 (a) In addition to any other special license plate, the 8 Secretary, upon receipt of all applicable fees and 9 applications made in the form prescribed by the Secretary of 10 State, may issue collegiate license plates. The collegiate 11 plates issued under this Section shall be affixed only to 12 passenger vehicles of the first division and motor vehicles 13 of the second division weighing not more than 8,000 pounds 14 and subject to the staggered registration system. Plates 15 issued under this Section shall expire according to the 16 staggered multi-year procedure established under Section 17 3-414.1 of this Code. 18 (b) The design, color, and format of the plates shall be 19 wholly within the discretion of the Secretary of State. The 20 Secretary of State may, at his or her discretion, issue the 21 plates for any public or degree-granting, not-for-profit 22 private college or university located in this State. The 23 Secretary may, in his or her discretion, allow the plates to 24 be issued as vanity plates or personalized in accordance with 25 Section 3-405.1 of this Code. The plates are not required to 26 designate "Land Of Lincoln", as prescribed in subsection (b) 27 of Section 3-412 of this Code. The Secretary shall prescribe 28 the eligibility requirements including a minimum level of 29 specialized license plates requests and, in his or her 30 discretion, shall approve and prescribe stickers or decals as 31 provided under Section 3-412. 32 (c) An applicant shall be charged a $40 fee for original 33 issuance in addition to the applicable registration fee. Of -12- LRB9212687DHgc 1 the original issuance fee in the case of a public university 2 or college, $25 shall be deposited into the State College and 3 University Trust Fund and $15 shall be deposited into the 4 Secretary of State Special License Plate Fund to be used by 5 the Secretary of State, subject to appropriation, to help 6 defray the administrative costs of issuing the plate. Of the 7 original issuance fee in the case of a degree-granting, 8 not-for-profit private college or university, $25 shall be 9 deposited into the University Grant Fund and $15 shall be 10 deposited into the Secretary of State Special License Plate 11 Fund to be used by the Secretary of State, subject to 12 appropriation, to help defray the administrative cost of 13 issuing the plate. In addition to the regular renewal fee, 14 an applicant shall be charged $27 for the renewal of eachset15oflicense plateplatesissued under this Section; $25 shall 16 be deposited into the State College and University Trust Fund 17 in the case of a public university or college or into the 18 University Grant Fund in the case of a degree-granting, 19 not-for-profit private college or university, and $2 shall be 20 deposited into the Secretary of State Special License Plate 21 Fund plates for all collegiate plates. 22 (d) The State College and University Trust Fund is 23 created as a special fund in the State treasury. The State 24 Treasurer shall create separate accounts within the State 25 College and University Trust Fund for each public university 26 or college for which collegiate license plates have been 27 issued. Moneys in the State College and University Trust 28 Fund shall be allocated to each account in proportion to the 29 number of plates sold in regard to each public university or 30 college. Moneys deposited into the State College and 31 University Trust Fund during the preceding calendar year 32 shall be distributed, subject to appropriation, to each 33 participating public university or college. This revenue 34 shall be used for the sole purpose of scholarship grant -13- LRB9212687DHgc 1 awards. 2 (e) The University Grant Fund is created as a special 3 fund in the State treasury. All moneys in the University 4 Grant Fund shall be appropriated to the Illinois Student 5 Assistance Commission to make reimbursements to participating 6 private colleges and universities under the Higher Education 7 License Plate Grant Program. 8 (Source: P.A. 90-14, eff. 7-1-97; 90-278, eff. 7-31-97; 9 90-774, eff. 8-14-98; 91-83, eff. 1-1-00.) 10 (625 ILCS 5/3-806.1) (from Ch. 95 1/2, par. 3-806.1) 11 Sec. 3-806.1. Additional fees for vanity license plates. 12 In addition to the regular registration fee, an applicant 13 shall be charged $94 for eachset ofvanity license plate 14platesissued to a motor vehicle of the first division or a 15 motor vehicle of the second division registered at not more 16 than 8,000 pounds or to a recreational vehicle and $50 for 17 eachset ofvanity plateplatesissued to a motorcycle. In 18 addition to the regular renewal fee, an applicant shall be 19 charged $13 for the renewal of eachset ofvanity license 20 plateplates. 21 (Source: P.A. 91-37, eff. 7-1-99.) 22 (625 ILCS 5/3-806.2) (from Ch. 95 1/2, par. 3-806.2) 23 Sec. 3-806.2. Limitations on no-fee plates. No 24 individual shall be issued more than one platepair of plates25 of any category for which no fee is required. The Secretary 26 of State may issue an additional platepairs of platesof any 27 such category upon receiving the required application and 28 registration fees. 29 (Source: P.A. 88-517.) 30 (625 ILCS 5/3-806.4) (from Ch. 95 1/2, par. 3-806.4) 31 Sec. 3-806.4. Gold Star recipients. Commencing with the -14- LRB9212687DHgc 1 1991 registration year, upon proper application, the 2 Secretary of State shall issue onepair ofregistration plate 3platesto any Illinois resident, who as the surviving widow 4 or widower, or in the absence thereof, as the surviving 5 parent, is awarded the Gold Star by the United States in 6 recognition of spouses or children who served in the Armed 7 Forces of the United States and lost their lives while in 8 service whether in peacetime or war. If the parent no longer 9 survives, the Secretary of State shall issue the plates to a 10 surviving sibling, of the person who served in the Armed 11 Forces, who is an Illinois resident. No more than one plate 12set of platesshall be issued for each Gold Star awarded, and 13 only one surviving parent, or in the absence of a surviving 14 parent, only one surviving sibling shall be issued aset of15 registration plateplates, except for those surviving parents 16 who, as recipients of the Gold Star, have legally separated 17 or divorced, in which case each surviving parent shall be 18 allowed oneset ofregistration plateplates. Registration 19 plates issued under this Section shall be for first division 20 vehicles and second division vehicles of 8,000 pounds or 21 less. An applicant shall be charged a $15 fee for the 22 original issuance in addition to the appropriate registration 23 fee which shall be deposited into the Road Fund to help 24 defray the administrative processing costs. For each 25 registration renewal period, a $2 fee, in addition to the 26 appropriate registration fee, shall be charged and 27 deposited into the Road Fund. 28 (Source: P.A. 90-534, eff. 11-14-97.) 29 (625 ILCS 5/3-810) (from Ch. 95 1/2, par. 3-810) 30 Sec. 3-810. Dealers, Manufacturers, Engine and Driveline 31 Component Manufacturers, Transporters and Repossessors - 32 Registration Plates. 33 (a) Dealers, manufacturers and transporters registered -15- LRB9212687DHgc 1 under this Act may obtain registration plates for use as 2 provided in this Act, at the following rates: 3 Initialset ofdealer's, manufacturer's or transporter's 4 "in-transit" plateplates: $45 5 Duplicate platePlates: $13 6 Manufacturers of engine and driveline components 7 registered under this Act may obtain registration plates at 8 the following rates: 9 Initialset of"test vehicle" plateplates: $94 10 Duplicate plateplates: $25 11 Repossessors and other persons qualified and registered 12 under Section 3-601 of this Act may obtain a registration 13 plateplatesat the rate of $45 per plateset. 14 (Source: P.A. 91-37, eff. 7-1-99.) 15 (625 ILCS 5/3-810.1) (from Ch. 95 1/2, par. 3-810.1) 16 Sec. 3-810.1. Tow-Truck - Registration Plates. 17 Tow-Truck operators registered under this Act may obtain 18 registration plates for use as provided in this Act at the 19 rate per platesetprovided in subsection (a) of Section 20 3-815 of this Code for each vehicle so registered. 21 (Source: P.A. 83-1473.) 22 (625 ILCS 5/3-820) (from Ch. 95 1/2, par. 3-820) 23 Sec. 3-820. Duplicate Number Plates. Upon filing in the 24 Office of the Secretary of State an affidavit to the effect 25 that an original number plate for a vehicle is lost, stolen 26 or destroyed, a duplicate number plate shall be furnished 27 upon payment of a fee of $6 for each duplicate plateand a28fee of $9 for a pair of duplicate plates. 29 Upon filing in the Office of the Secretary of State an 30 affidavit to the effect that an original registration sticker 31 for a vehicle is lost, stolen or destroyed, a new 32 registration sticker shall be furnished upon payment of a fee -16- LRB9212687DHgc 1 of $5. 2 The Secretary of State may, in his discretion, assign a 3 new number plateor platesin lieu of a duplicate of the 4 plateor platesso lost, stolen or destroyed, but such 5 assignment of a new plateor platesshall not affect the 6 right of the owner to secure a reassignment of his original 7 registration number in the manner provided in this Act. The 8 fee for one new number plate shall be $6, and for a pair of9new number plates, $9. 10 For the administration of this Section, the Secretary 11 shall consider the loss of a registration plateor plates12 with properly affixed registration stickers as requiring the 13 payment ofeither$11 for each duplicateor $14 for a pair of14duplicate plates or $19 for a pair of duplicate plates if15stickers are required on both front and rear registration16plates. 17 (Source: P.A. 91-37, eff. 7-1-99.) 18 (625 ILCS 5/5-201) (from Ch. 95 1/2, par. 5-201) 19 Sec. 5-201. Transporters must apply for in-transit 20 plates. 21 (a) No person shall engage in this State in the business 22 as a transporter until such person shall apply for and 23 receive from the Secretary of State a generally distinctive 24set of two"in-transit license plateplates" for any vehicle 25 so transported by him. 26 (b) An application for a generally distinctive number 27 under this Article shall be filed with the Secretary of 28 State, duly verified by oath and in such form as the 29 Secretary of State may by rule or regulation prescribe and 30 shall contain the name and business address of such person, 31 the certificate, registration or permit number issued by the 32 Illinois Commerce Commission and such other information 33 concerning the business of the applicant as the Secretary of -17- LRB9212687DHgc 1 State may by rule or regulation prescribe. If the applicant 2 does not hold a certificate, registration or permit from the 3 Illinois Commerce Commission to so transport, such 4 application shall be denied. 5 (c) An application for a generally distinctiveset of6two"in-transit license plateplates" shall be accompanied by 7 the prescribed fee. Upon the payment of such license fee, 8 such application shall be filed and recorded in the office of 9 the Secretary of State. Thereupon the Secretary of State 10 shall assign and issue to such person a generally distinctive 11 number and without any further expense to him shall deliver 12 to such person at his business address a certificate of 13 registration in such form as the Secretary of State may 14 prescribe and oneset of two"in-transit license plate 15plates" with a number corresponding to the number of such 16 certificate of registration. Such in-transit plateplates17 shall be used by such person only on vehicles transported, 18 but not owned, by him. 19 (d) Except as provided in sub-section (3) hereof, all 20 certificates of registration and "in-transit plates" granted 21 under this Section shall expire by operation of law on 22 December 31 of the calendar year for which they are granted 23 unless sooner revoked under the provisions of Section 5-501 24 of this Chapter. 25 (e) A certificate of registration under this Article may 26 be renewed upon application and payment of the fee required 27 herein as in the case of an original application, provided, 28 however, that in case an application for renewal of an 29 effective registration is made during the month of December, 30 such existing registration shall remain in force until such 31 application for renewal is granted by the Secretary of State. 32 (f) Any person registered as a transporter under the 33 Article may make application for additional duplicatesets of34 "in-transit plates" on such form as the Secretary of State -18- LRB9212687DHgc 1 may by rule or regulation prescribe, from time to time to 2 obtain as many duplicatesets of"in-transit plates" as he 3 may desire upon payment of the prescribed fee for each plate 4set. Such duplicate plates shall bear the number of that 5 person's original certificate of registration. 6 (g) In case of loss or destruction of one license plate 7 issued to a transporter under this Section such transporter 8 may obtain a duplicate of the same by filing an affidavit to 9 that effect with the Secretary of State, accompanied by the 10 prescribed fee. 11 (h) An original "in-transit plate" or a duplicate shall 12 be attached to thefront andrear of each vehicle so 13 transported in this State; provided, that if one such vehicle 14 is towing another such vehicle, one plate or duplicate plate 15 shall be attachedto the front of the towing vehicle and one16such plateto the rear of the rearmost towed vehicle. 17 (i) Anything in this Chapter to the contrary 18 notwithstanding, the provisions of this Section shall not 19 apply to a non-resident engaged in such business and using 20 the public highways of this State if he has an "in-transit 21 plate" or license from the State, foreign country or 22 province, territory or federal district of which he is a 23 resident and such State, country, province, territory or 24 district grants a like exemption to residents of this State. 25 (Source: P.A. 76-1586.) 26 (625 ILCS 5/5-202) (from Ch. 95 1/2, par. 5-202) 27 Sec. 5-202. Tow or Wrecker operators must register tow 28 or wrecker vehicles. (a) No person in this State shall 29 engage in the business of operating a tow truck or wrecker or 30 operate a tow or wrecker vehicle until such person shall 31 register any vehicle to be used for such purpose and apply 32 for and receive from the Secretary of State a generally 33 distinctive set of 23"tow truck" plates for any towing or -19- LRB9212687DHgc 1 wrecker vehicle operated by him. 2 (b) An application for registration for a generally 3 distinctive set of 23"tow truck" plates under this Article 4 shall be filed with the Secretary of State, duly verified by 5 oath and in such form as the Secretary of State may by rule 6 or regulation prescribe and shall contain the name and 7 business address of such person, the vehicle identification 8 number of the vehicle for which such application is made, 9 proof of insurance as set forth in paragraph (d) of Section 10 12-606 of this Code, and such other information concerning 11 the business of the applicant as the Secretary of State may 12 by rule or regulation prescribe. 13 (c) The application for registration and a generally 14 distinctive set of 23"tow truck" plates shall be 15 accompanied by the prescribed fee. Upon payment of such fee, 16 such registration and application shall be filed and recorded 17 in the office of the Secretary of State. Thereupon the 18 Secretary of State shall assign and issue to such person a 19 generally distinctive number for each vehicle and without 20 further expense to him shall deliver to such person at his 21 place of business address one set of 23"tow truck" plates. 22 Such "tow truck" plates shall be used by such person only on 23 the vehicle for which application was made and the vehicle 24 being towed, and are not transferable. 25 (d) All "tow truck" plates granted under this Section 26 shall expire by operation of law on December 31 of the 27 calendar year for which they are granted unless sooner 28 revoked under the provisions of Section 5-501 of this 29 Chapter. 30 (e) One "tow truck" plate shall be attached to thefront31andrear of each registered vehicle, and one "tow truck" 32 plate shall be attached to the rear of the vehicle being 33 towed unless the towed vehicle displays a valid registration 34 plate visible from the rear while being towed, so that the -20- LRB9212687DHgc 1 numbers and letter on the plate are clearly visible to any 2 person following the vehicle being towed. However, 3 illumination of the rear plate required by subsection (c) of 4 Section 12-201 of this Code shall not apply to the second 5thirdplate displayed on the towed vehicle.
