92_SB1555 SRS92SB0047ABsp 1 AN ACT concerning higher education institutions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Higher Education Institution Symbol and Trademark Act. 6 Section 5. Definition of public institution of higher 7 education. "Public institution of higher education" means any 8 of the State's public institutions of higher education, as 9 defined in the Board of Higher Education Act. 10 Section 10. Use of symbol or trademark prohibited. No 11 person, firm or corporation shall use the symbol or trademark 12 of a public institution of higher education, as designated by 13 that institution, without the prior consent of that 14 institution. 15 Section 15. Penalty. A person who violates Section 10 of 16 this Act is guilty of a Class C misdemeanor for a first 17 offense and a Class A misdemeanor for a second or subsequent 18 offense. Each instance in which a person violates Section 10 19 of this Act constitutes a separate violation of Section 10 of 20 this Act. 21 Section 99. Effective date. This Act takes effect upon 22 becoming law.
