92_SB1546 LRB9211260WHprA 1 AN ACT concerning business transactions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Consumer Fraud and Deceptive Business 5 Practices Act is amended by adding Section 2MM as follows: 6 (815 ILCS 505/2MM new) 7 Sec. 2MM. Receipts; credit card account number. 8 (a) Except as otherwise provided in this Section, a 9 person who accepts credit cards for the transaction of 10 business may not print more than the last 5 digits of the 11 credit card account number or the expiration date upon any 12 receipt provided to the cardholder. A person who violates 13 this Section commits an unlawful practice within the meaning 14 of this Act. 15 (b) This Section applies only to receipts that are 16 electronically printed and does not apply to transactions in 17 which the sole means of recording the person's credit card 18 number is by handwriting or by an imprint or copy of the 19 credit card. 20 (c) This Section becomes operative on January 1, 2007, 21 with respect to any cash register or other machine or device 22 that electronically prints receipts for credit card 23 transactions that is in use before January 1, 2004. 24 (d) This Section becomes operative on January 1, 2004, 25 with respect to any cash register or other machine or device 26 that electronically prints receipts for credit card 27 transactions that is first put into use on or after January 28 1, 2004. 29 (e) As used in this Section, "credit card" has the 30 meaning ascribed to that term in Section 2.03 of the Illinois 31 Credit Card and Debit Card Act. -2- LRB9211260WHprA 1 Section 99.
