92_SB1531eng SB1531 Engrossed SDS/92Abill0018/AJhs 1 AN ACT to honor and commemorate the victims of the 2 terrorist attacks on September 11, 2001. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The State Commemorative Dates Act is amended 6 by adding Section 86 as follows: 7 (5 ILCS 490/86 new) 8 Sec. 86. September 11th Day of Remembrance. September 9 11th of each year is designated as September 11th Day of 10 Remembrance to be observed throughout the State as a day set 11 apart in honor and remembrance of the persons killed and 12 injured in the terrorist attacks on September 11, 2001. 13 Section 10. The State Finance Act is amended by adding 14 Section 5.567 as follows: 15 (30 ILCS 105/5.567 new) 16 Sec. 5.567. The September 11th Fund. 17 Section 15. The School Code is amended by changing 18 Section 24-2 as follows: 19 (105 ILCS 5/24-2) (from Ch. 122, par. 24-2) 20 Sec. 24-2. Holidays. Teachers shall not be required to 21 teach on Saturdays; nor shall teachers or other school 22 employees, other than noncertificated school employees whose 23 presence is necessary because of an emergency or for the 24 continued operation and maintenance of school facilities or 25 property, be required to work on legal school holidays, which 26 are January 1, New Year's Day; the third Monday in January, 27 the Birthday of Dr. Martin Luther King, Jr.; February 12, the SB1531 Engrossed -2- SDS/92Abill0018/AJhs 1 Birthday of President Abraham Lincoln; the first Monday in 2 March (to be known as Casimir Pulaski's birthday); Good 3 Friday; the day designated as Memorial Day by federal law; 4 July 4, Independence Day; the first Monday in September, 5 Labor Day; the second Monday in October, Columbus Day; 6 November 11, Veteran's Day; the Thursday in November commonly 7 called Thanksgiving Day; and December 25, Christmas Day. 8 School boards may grant special holidays whenever in their 9 judgment such action is advisable, except that no school 10 board or board of education may designate or observe as a 11 special holiday on which teachers or other school employees 12 are not required to work the days on which general elections 13 for members of the Illinois House of Representatives are 14 held. No deduction shall be made from the time or 15 compensation of a school employee on account of any legal or 16 special holiday. 17 Commemorative holidays, which recognize specified 18 patriotic, civic, cultural or historical persons, activities, 19 or events, are regular school days. Commemorative holidays 20 are: January 28 (to be known as Christa McAuliffe Day and 21 observed as a commemoration of space exploration), February 22 15 (the birthday of Susan B. Anthony), March 29 (Viet Nam War 23 Veterans Day), September 11 (September 11th Day of 24 Remembrance), the school day immediately preceding Veteran's 25 Day (Korean War Veterans Day), October 1 (Recycling Day), 26 December 7 (Pearl Harbor Veterans Day) and any day so 27 appointed by the President or Governor. School boards may 28 establish commemorative holidays whenever in their judgment 29 such action is advisable. School boards shall include 30 instruction relative to commemorated persons, activities, or 31 events on the commemorative holiday or at any other time 32 during the school year and at any point in the curriculum 33 when such instruction may be deemed appropriate. The State 34 Board of Education shall prepare and make available to school SB1531 Engrossed -3- SDS/92Abill0018/AJhs 1 boards instructional materials relative to commemorated 2 persons, activities, or events which may be used by school 3 boards in conjunction with any instruction provided pursuant 4 to this paragraph. 5 City of Chicago School District 299 shall observe March 4 6 of each year as a commemorative holiday. This holiday shall 7 be known as Mayors' Day which shall be a day to commemorate 8 and be reminded of the past Chief Executive Officers of the 9 City of Chicago, and in particular the late Mayor Richard J. 10 Daley and the late Mayor Harold Washington. If March 4 falls 11 on a Saturday or Sunday, Mayors' Day shall be observed on the 12 following Monday. 13 (Source: P.A. 89-610, eff. 8-6-96; 89-622, eff. 8-9-96; 14 90-14, eff. 7-1-97.) 15 Section 20. The Illinois Vehicle Code is amended by 16 adding Section 3-653 as follows: 17 (625 ILCS 5/3-653 new) 18 Sec. 3-653. September 11th license plates. 19 (a) Beginning on September 11, 2002, the Secretary, upon 20 receipt of all applicable fees and applications made in the 21 form prescribed by the Secretary, may issue special 22 registration plates designated as September 11th license 23 plates. 24 The special plates issued under this Section shall be 25 affixed only to passenger vehicles of the first division or 26 motor vehicles of the second division weighing not more than 27 8,000 pounds. 28 Plates issued under this Section shall expire according 29 to the multi-year procedure established by Section 3-414.1 of 30 this Code. 31 (b) The design and color of the special plates shall be 32 wholly within the discretion of the Secretary. The Secretary SB1531 Engrossed -4- SDS/92Abill0018/AJhs 1 may allow the plates to be issued as vanity or personalized 2 plates under Section 3-405.1 of this Code. The Secretary 3 shall prescribe stickers or decals as provided under Section 4 3-412 of this Code. 5 (c) An applicant for the special plate shall be charged 6 a $40 fee for original issuance in addition to the 7 appropriate registration fee. Of this fee, $25 shall be 8 deposited into the September 11th Fund and $15 shall be 9 deposited into the Secretary of State Special License Plate 10 Fund, to be used by the Secretary to help defray the 11 administrative processing costs. 12 For each registration renewal period, a $27 fee, in 13 addition to the appropriate registration fee, shall be 14 charged. Of this fee, $25 shall be deposited into the 15 September 11th Fund and $2 shall be deposited into the 16 Secretary of State Special License Plate Fund. 17 (d) The September 11th Fund is created as a special fund 18 in the State treasury. Subject to appropriation by the 19 General Assembly and approval by the Secretary, the Director 20 of Commerce and Community Affairs shall pay all moneys in the 21 September 11th Fund as grants to aid victims of terrorism and 22 as grants to local governments to cover the costs of 23 training, equipment, and other items related to public safety 24 initiatives intended to prevent further acts of terrorism or 25 to respond to further acts of terrorism or other disasters or 26 emergency situations in Illinois. 27 Section 99. Effective date. This Act takes effect upon 28 becoming law.
