 1        AN ACT concerning the duties of the Governor.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Regulatory  Sunset  Act  is amended by
 5    changing Section 5 as follows:

 6        (5 ILCS 80/5) (from Ch. 127, par. 1905)
 7        Sec. 5.  Study and report.   The  Bureau  of  the  Budget
 8    shall  study  the  performance  of each regulatory agency and
 9    program scheduled for termination under this Act  and  report
10    annually to the Governor the results of such study, including
11    in  the report recommendations with respect to those agencies
12    and programs the Bureau of the Budget  determines  should  be
13    terminated  or  continued  by  the State.  The Governor shall
14    review the report of the Bureau of the  Budget  and  in  each
15    even-numbered   year  make  recommendations  to  the  General
16    Assembly on the termination  or  continuation  of  regulatory
17    agencies  and programs.  The Governor's recommendations shall
18    be made a part of the State budget submitted to  the  General
19    Assembly in even-numbered years.

22        Section  10.   The  Small  Business  Tax  Policy  Act  is
23    repealed.

24        Section  15.   The  Counties  Code is amended by changing
25    Section 5-15011 as follows:

27        Sec. 5-15011. Construction  and  maintenance  of  sewers.
28    Every such county is authorized to construct, maintain, alter

 1    and  extend  its  sewers,  pipelines,  channels,  ditches and
 2    drains along, upon, under and  across  any  highway,  street,
 3    alley  or  public  ground  in  the  State  as a proper use of
 4    highways, but so as not to incommode the public use  thereof,
 5    and the right and authority are granted to any such county to
 6    construct,  maintain  and  operate  any conduits, mainpipe or
 7    pipes, wholly or partially submerged, buried,  or  otherwise,
 8    in,  upon  and  along any of the lands owned by the State and
 9    under any of the public waters therein;  provided,  that  the
10    extent and location of the lands and waters so to be used and
11    appropriated  shall be approved in writing by the appropriate
12    State agency Governor, upon  application  duly  made  to  him
13    asking  for  such  approval:  And  provided further, that the
14    rights, permission and  authority  hereby  granted  shall  be
15    subject  to all public rights of commerce and navigation, and
16    to the authority of the  United  States  in  behalf  of  such
17    public  rights and also to the right of the State to regulate
18    and control fishing in the public waters.

20        Section 20.  The  School  Code  is  amended  by  changing
21    Sections 27-18 and 27-20.1 as follows:

23        Sec.  27-18. Arbor and bird day. The last Friday in April
24    is  designated  The  Governor  shall  annually  designate  by
25    official proclamation a day in the  spring  to  be  known  as
26    "Arbor  and Bird Day," to be observed throughout the State as
27    a day for planting  trees,  shrubs  and  vines  about  public
28    grounds,  and as a day on which to hold appropriate exercises
29    in the public schools and elsewhere tending to show the value
30    of trees and birds and the necessity for their protection.

 1        (105 ILCS 5/27-20.1) (from Ch. 122, par. 27-20.1)
 2        Sec. 27-20.1. Illinois Law Week. The  first  full  school
 3    week  in  May is designated "Illinois Law Week". The Governor
 4    shall annually designate by official proclamation one week in
 5    May to be  known  as  "Illinois  Law  Week"  to  be  observed
 6    throughout  the State to foster the importance of law and the
 7    respect thereof in Illinois. During  that  week,  the  public
 8    schools  may devote appropriate time, instruction, study, and
 9    exercises in  the  procedures  of  the  legislature  and  the
10    enactment  of  laws,  the  courts  and  the administration of
11    justice, the police  and  the  enforcement  of  law,  citizen
12    responsibilities,  and other principles and ideals to promote
13    the importance of government under law in the State.

16        Section 25.  The Coal Mining Act is amended by  repealing
17    Section 4.04.

18        Section 30.  The Illinois Diseased Animals Act is amended
19    by changing Section 11 as follows:

21        Sec.  11.   All claims against the State arising from the
22    slaughter of animals as herein provided for, shall be made to
23    the Department under such rules, not inconsistent  with  this
24    Act, as the Department may prescribe.
25        The  Department  shall,  after  inspection,  hearing  and
26    inquiry  by  appraisers,  in  each  case determine the amount
27    which shall be paid on account of the animals so slaughtered,
28    which amount shall be the fair market value in health thereof
29    and not less than the net market value for meat  consumption,
30    provided  that  where  the  appraisals  exceed the net market
31    value for meat consumption in  health  thereof  the  payments

 1    shall not be in excess of the following amounts:
 2        (a)  bovine   species,   for  beef,  dairy  and  breeding
 3    purposes $300 for any registered  animal  and  $150  for  any
 4    unregistered  animal,  but  not to exceed an average value of
 5    $250 per head for all such registered animals in any herd and
 6    not to exceed an average value of  $125  per  head  for  such
 7    nonregistered animals in any herd;
 8        (b)  equine species, $500 for any one animal;
 9        (c)  swine, $50 per head for grade swine and $100 for any
10    registered  purebred animal or any breeding animal upon which
11    a certificate of registration has been issued by an  approved
12    inbred livestock registry association;
13        (d)  sheep, not to exceed $25 for any unregistered sheep,
14    and not to exceed $75 for any registered sheep.
15        No  value other than the market utility value of any such
16    animal  shall  be  allowed  or  fixed,  however,   unless   a
17    certificate   of   registration   issued   by   the  registry
18    association, of the breed of such animal, recognized  by  the
19    United States Government, is furnished to the appraisers. The
20    appraisers  shall report under oath the value of the animals,
21    together with a statement of the evidence or facts upon which
22    the appraisement is based, and the Department  shall  certify
23    the  appraisement  and  statement  to  the  Governor  for his
24    approval.  If the Governor finds  that  the  appraisers  have
25    proceeded  in  accordance  with  law,  he shall approve their
26    appraisement for payment, and  The  Comptroller  shall,  upon
27    presentation  of  the  appraisement  to him, draw his warrant
28    upon the  State  Treasurer  for  the  amount  fixed  by  such
29    appraisers  in  favor  of the owner of the animals; provided,
30    that where Federal authority authorizes the payment  of  part
31    of  the  value  of  such animals the State shall only pay the
32    balance of such appraisement fixed as aforesaid.

 1        Section 99.  Effective date.  This Act takes effect  upon
 2    becoming law.
