92_SB1137sam001 LRB9208156NTsbam01 1 AMENDMENT TO SENATE BILL 1137 2 AMENDMENT NO. . Amend Senate Bill 1137 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Asbestos Abatement Act is amended by 5 changing Section 7 as follows: 6 (105 ILCS 105/7) (from Ch. 122, par. 1407) 7 Sec. 7. Consistency with federal law. Rules and 8 regulations issued pursuant to this Act, including those 9 governing the preparation of a list of contractors and the 10 removal of contractors therefrom as provided for in Section 11 10, shall not be inconsistent with rules and regulations 12 promulgated by the United States Environmental Protection 13 Agency pursuant to the Toxic Substances Control Act, the 14 Clean Air Act or other applicable federal statutes. Rules 15 issued under this Act shall incorporate the United States 16 Occupational Safety and Health Administration Asbestos 17 Construction Standard, 29 C.F.R. Part 1926.1101, as revised 18 June 29, 1998 or thereafter, and the United States 19 Occupational Safety and Health Administration Instruction CPL 20 2-2.63 (November 3, 1995, as amended January 9, 1996), 21 including the Appendix D Settlement Agreement with the 22 Flooring Industry. The Department shall not enforce or -2- LRB9208156NTsbam01 1 attempt to enforce rules that impose requirements different 2 than the aforementioned United States Occupational Safety and 3 Health Administration Standard and Instruction. 4 (Source: P.A. 84-951.) 5 Section 10. The Commercial and Public Building Asbestos 6 Abatement Act is amended by changing Section 25 as follows: 7 (225 ILCS 207/25) 8 Sec. 25. Consistency with federal law. Rules issued 9 under this Act, including those governing the preparation of 10 a list of response action contractors and the removal of 11 response action contractors from the list as provided for in 12 Section 20, shall not be inconsistent with rules and 13 regulations promulgated by the United States Environmental 14 Protection Agency under the Toxic Substances Control Act, the 15 Clean Air Act, or other applicable federal statutes. Rules 16 issued under this Act shall incorporate the United States 17 Occupational Safety and Health Administration Asbestos 18 Construction Standard, 29 C.F.R. Part 1926.1101, as revised 19 June 29, 1998 or thereafter, and the United States 20 Occupational Safety and Health Administration Instruction CPL 21 2-2.63 (November 3, 1995, as amended January 9, 1996), 22 including the Appendix D Settlement Agreement with the 23 Flooring Industry. Effective date. This Act takes effect upon 29 becoming law.".
