92_SB1035sam001 LRB9205703NTsbam01 1 AMENDMENT TO SENATE BILL 1035 2 AMENDMENT NO. . Amend Senate Bill 1035 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The School Code is amended by changing 5 Sections 10-22.36 and 17-2A as follows: 6 (105 ILCS 5/10-22.36) (from Ch. 122, par. 10-22.36) 7 Sec. 10-22.36. Buildings for school purposesand offices. 8 To build or,purchaseor movea building for school classroom 9 or instructional purposesor office facilitiesupon the 10 approval of a majority of the voters upon the proposition at 11 a referendum held for such purpose or in accordance with 12 Section 17-2.11. The board may initiate such referendum by 13 resolution. The board shall certify the resolution and 14 proposition to the proper election authority for submission 15 in accordance with the general election law. 16 The questions of building one or more new buildings for 17 school purposes or office facilities, and issuing bonds for 18 the purpose of borrowing money to purchase one or more 19 buildings or sites for such buildings or office sites, to 20 build one or more new buildings for school purposes or office 21 facilities or to make additions and improvements to existing 22 school buildings, may be combined into one or more -2- LRB9205703NTsbam01 1 propositions on the ballot. 2 Before erecting, or purchasing or remodeling such a 3 building the board shall submit the plans and specifications 4 respecting heating, ventilating, lighting, seating, water 5 supply, toilets and safety against fire to the regional 6 superintendent of schools having supervision and control over 7 the district, for approval in accordance with Section 2-3.12. 8 Notwithstanding any of the foregoing, no referendum shall 9 be required if the purchase, construction, or buildingor10movingof any such buildingor office facilityis completed 11 (1) while the building is being leased by the school district 12 or (2) with the expenditure of (A) funds derived from the 13 sale or disposition of other buildings, land, or structures 14 of the school district or (B) funds received (i) as a grant 15 under the School Construction Law or (ii) as gifts or 16 donations, provided that no funds to complete such building, 17 other than lease payments,or office facilityare derived 18 from the district's bonded indebtedness or the tax levy of 19 the district. 20 (Source: P.A. 86-686; 86-1010; 86-1040; 86-1331; 87-306; 21 87-984.) 22 (105 ILCS 5/17-2A) (from Ch. 122, par. 17-2A) 23 Sec. 17-2A. Interfund Transfers. The school board of any 24 district having a population of less than 500,000 25 inhabitants,may, by proper resolution following a public 26 hearing set by the school board or the president of the 27 school board (that is preceded (i) by at least one published 28 notice over the name of the clerk or secretary of the board, 29 occurring at least 7 days and not more than 30 days prior to 30 the hearing, in a newspaper of general circulation within the 31 school district and (ii) by posted notice over the name of 32 the clerk or secretary of the board, at least 48 hours before 33 the hearing, at the principal office of the school board or -3- LRB9205703NTsbam01 1 at the building where the hearing is to be held if a 2 principal office does not exist, with both notices setting 3 forth the time, date, place, and subject matter of the 4 hearing), transfer from (1) the Educational Fund to the 5 Operations and Maintenance Fund or the Transportation Fund, 6 (2) the Operations and Maintenance Fund to the Educational 7 Fund or the Transportation Fund, or (3) the Transportation 8 Fund to the Educational Fund or the Operations and 9 Maintenance Fund of said district an amount of money not to 10 exceed 20% of the tax actually received in the transferor 11 Fund for the year previous to the transfer, provided such 12 transfer is made solely for the purpose of meeting one-time, 13 non-recurring expenses. Any other permanent interfund 14 transfers authorized by any provision or judicial 15 interpretation of this Code for which the transferee Fund is 16 not precisely and specifically set forth in the provision of 17 this Code authorizing such transfer shall be made to the Fund 18 of the school district most in need of the funds being 19 transferred, as determined by resolution of the school board. 20 (Source: P.A. 89-3, eff. 2-27-95.)".
