92_SB0922 LRB9208125DHmb 1 AN ACT regarding vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 changing Section 11-1413 as follows: 6 (625 ILCS 5/11-1413) (from Ch. 95 1/2, par. 11-1413) 7 Sec. 11-1413. Depositing material on highway prohibited. 8 (a) No person shall throw, spill or deposit upon any 9 highway any bottle, glass, nails, tacks, wire, cans, or any 10 litter (as defined in Section 3 of the Litter Control Act). 11 (b) Any person who violates subsection (a) upon any 12 highway shall immediately remove such material or cause it to 13 be removed. 14 (c) Any person removing a wrecked or damaged vehicle 15 from a highway shall remove any glass or other debris, except 16 any hazardous substance as defined in Section 3.14 of the 17 Environmental Protection Act, hazardous waste as defined in 18 Section 3.15 of the Environmental Protection Act, and 19 potentially infectious medical waste as defined in Section 20 3.84 of the Environmental Protection Act, dropped upon the 21 highway from such vehicle. 22 (d) Any person in charge of a construction site must 23 maintain the entrance road or roads to prevent mud, rocks, 24 stones, and other construction material from being tracked 25 onto any adjacent highway by construction or delivery 26 vehicles. It is the responsibility of the person in charge 27 of the site to keep any adjacent highways free from 28 construction debris. When a police officer notifies the 29 person in charge of a construction site that an adjacent 30 highway to a construction site must be cleaned, that person 31 must immediately cause the removal of all construction -2- LRB9208125DHmb 1 debris. Failure to comply within a reasonable time with an 2 order to remove all construction debris is a petty offense. 3 For the purpose of this subsection (d), debris includes, but 4 is not limited to, sand, clay, mud, stones, rocks, and 5 construction materials. 6 (Source: P.A. 87-190; 88-415; 88-670, eff. 12-2-94.)
