Amend Senate Bill 847 by replacing 3 the title with the following: 4 "AN ACT concerning public utilities."; and 5 by replacing everything after the enacting clause with the 6 following: 7 "Section 5. The Public Utilities Act is amended by 8 changing Section 2-102 as follows: 9 (220 ILCS 5/2-102) (from Ch. 111 2/3, par. 2-102) 10 Sec. 2-102. Commissioners; bond; oath. 11 (a) Each commissioner and each person appointed to 12 office by the Commission shall before entering upon the 13 duties of his office take and subscribe the constitutional 14 oath of office. 15 Before entering upon the duties of his office each 16 commissioner shall give bond, with security to be approved by 17 the Governor, in the sum of $20,000, conditioned for the 18 faithful performance of his duty as such commissioner. 19 Every person appointed or employed by the Commission, may, in 20 the discretion of the Commission, before entering upon the 21 duties of his office, be required to give bond for the -2- LRB9207148JSpcam01 1 faithful discharge of his duties, in such sum as the 2 Commission may designate, which bond shall be approved by the 3 Commission. 4 All bonds required to be filed pursuant to this section 5 shall be filed in the office of the Secretary of State. 6 (b) No person in the employ of or holding any official 7 relation to any corporation or person subject in whole or in 8 part to regulation by the Commission, and no person holding 9 stock or bonds in any such corporation, or who is in any 10 other manner pecuniarily interested therein, directly or 11 indirectly, shall be appointed to or hold the office of 12 commissioner or be appointed or employed by the Commission; 13 and if any such person shall voluntarily become so interested 14 his office or employment shall ipso facto become vacant. If 15 any person become so interested otherwise than voluntarily he 16 shall within a reasonable time divest himself of such 17 interest, and if he fails to do so his office or employment 18 shall become vacant. 19 No commissioner or person appointed or employed by the 20 Commission shall solicit or accept any gift, gratuity, 21 emolument or employment from any person or corporation 22 subject to the supervision of the Commission, or from any 23 officer, agent or employee thereof; nor solicit, request from 24 or recommend, directly or indirectly, to any such person or 25 corporation, or to any officer, agent or employee thereof the 26 appointment of any person to any place or position. Every 27 such corporation and person, and every officer, agent or 28 employee thereof, is hereby forbidden to offer to any 29 commissioner or to any person appointed or employed by the 30 Commission any gift, gratuity, emolument or employment. If 31 any commissioner or any person appointed or employed by the 32 Commission shall violate any provisions of this paragraph he 33 shall be removed from the office or employment held by him. 34 Every person violating the provisions of this paragraph shall -3- LRB9207148JSpcam01 1 be guilty of a Class A misdemeanor. 2 (c) Each commissioner shall devote his entire time to 3 the duties of his office, and shall hold no other office or 4 position of profit, or engage in any other business, 5 employment or vocation. 6 (Source: P.A. 84-617.)".
