 1        AN ACT relating to university presidents and chancellors.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The University of Illinois Act is amended  by
 5    adding Section 4.2 as follows:

 6        (110 ILCS 305/4.2 new)
 7        Sec.    4.2.  Private    sector   service;   compensation
 8    prohibited.
 9        (a)  No person who is employed as the President or  as  a
10    chancellor  of the University of Illinois may contract for or
11    accept any payment of  money  or  other  thing  of  value  or
12    economic benefit as an honorarium, per diem, salary, or other
13    form  of  compensation in return for his or her service as an
14    officer, director, trustee, or other member of the  governing
15    or executive board of a private, for-profit or not-for-profit
16    association,  foundation,  business  trust,  corporation,  or
17    other  business  entity located or doing business in Illinois
18    or in any other state.
19        (b)  The President or chancellor shall not be  deemed  to
20    have  accepted  a payment of money or other thing of value or
21    economic benefit from an entity described in  subsection  (a)
22    in  violation  of that subsection if that entity pays for, or
23    reimburses the President or  chancellor  who  pays  for,  the
24    reasonable  travel,  lodging,  and  meal  expenses  that  are
25    actually   and  necessarily  incurred  by  the  President  or
26    chancellor in order  to  attend  a  regular  meeting  of  the
27    governing or executive board of that entity.
28        (c)  If  the  President or a chancellor accepts a payment
29    of money or other thing  of  value  or  economic  benefit  in
30    violation   of   subsection  (a):   (i)  the  same  shall  be
31    surrendered by the  President  or  chancellor  to  the  State

 1    Treasurer  and  deposited  into  the  General Revenue Fund or
 2    otherwise held for the use and benefit of the State; and (ii)
 3    the employment  of  the  President  or  chancellor  shall  be
 4    terminated  by  the  board  of  trustees of the University of
 5    Illinois unless the President or chancellor establishes  good
 6    cause why his or her employment should not be terminated.

 7        Section  10.  The Southern Illinois University Management
 8    Act is amended by adding Section 8.1 as follows:

 9        (110 ILCS 520/8.1 new)
10        Sec.   8.1.  Private   sector    service;    compensation
11    prohibited.
12        (a)  No  person  who is employed as the President or as a
13    chancellor of Southern Illinois University may  contract  for
14    or  accept  any  payment  of money or other thing of value or
15    economic benefit as an honorarium, per diem, salary, or other
16    form of compensation in return for his or her service  as  an
17    officer,  director, trustee, or other member of the governing
18    or executive board of a private, for-profit or not-for-profit
19    association,  foundation,  business  trust,  corporation,  or
20    other business entity located or doing business  in  Illinois
21    or in any other state.
22        (b)  The  President  or chancellor shall not be deemed to
23    have accepted a payment of money or other thing of  value  or
24    economic  benefit  from an entity described in subsection (a)
25    in violation of that subsection if that entity pays  for,  or
26    reimburses  the  President  or  chancellor  who pays for, the
27    reasonable  travel,  lodging,  and  meal  expenses  that  are
28    actually  and  necessarily  incurred  by  the  President   or
29    chancellor  in  order  to  attend  a  regular  meeting of the
30    governing or executive board of that entity.
31        (c)  If the President or a chancellor accepts  a  payment
32    of  money  or  other  thing  of  value or economic benefit in

 1    violation  of  subsection  (a):   (i)  the  same   shall   be
 2    surrendered  by  the  President  or  chancellor  to the State
 3    Treasurer and deposited into  the  General  Revenue  Fund  or
 4    otherwise held for the use and benefit of the State; and (ii)
 5    the  employment  of  the  President  or  chancellor  shall be
 6    terminated by the board  of  trustees  of  Southern  Illinois
 7    University  unless  the  President  or chancellor establishes
 8    good  cause  why  his  or  her  employment  should   not   be
 9    terminated.

10        Section  15.  The Chicago State University Law is amended
11    by adding Section 5-46 as follows:

12        (110 ILCS 660/5-46 new)
13        Sec.   5-46.  Private   sector   service;    compensation
14    prohibited.
15        (a)  No  person  who is employed as the President or as a
16    chancellor of Chicago State University may  contract  for  or
17    accept  any  payment  of  money  or  other  thing of value or
18    economic benefit as an honorarium, per diem, salary, or other
19    form of compensation in return for his or her service  as  an
20    officer,  director, trustee, or other member of the governing
21    or executive board of a private, for-profit or not-for-profit
22    association,  foundation,  business  trust,  corporation,  or
23    other business entity located or doing business  in  Illinois
24    or in any other state.
25        (b)  The  President  or chancellor shall not be deemed to
26    have accepted a payment of money or other thing of  value  or
27    economic  benefit  from an entity described in subsection (a)
28    in violation of that subsection if that entity pays  for,  or
29    reimburses  the  President  or  chancellor  who pays for, the
30    reasonable  travel,  lodging,  and  meal  expenses  that  are
31    actually  and  necessarily  incurred  by  the  President   or
32    chancellor  in  order  to  attend  a  regular  meeting of the

 1    governing or executive board of that entity.
 2        (c)  If the President or a chancellor accepts  a  payment
 3    of  money  or  other  thing  of  value or economic benefit in
 4    violation  of  subsection  (a):   (i)  the  same   shall   be
 5    surrendered  by  the  President  or  chancellor  to the State
 6    Treasurer and deposited into  the  General  Revenue  Fund  or
 7    otherwise held for the use and benefit of the State; and (ii)
 8    the  employment  of  the  President  or  chancellor  shall be
 9    terminated  by  the  board  of  trustees  of  Chicago   State
10    University  unless  the  President  or chancellor establishes
11    good  cause  why  his  or  her  employment  should   not   be
12    terminated.

13        Section  20.   The  Eastern  Illinois  University  Law is
14    amended by adding Section 10-46 as follows:

15        (110 ILCS 665/10-46 new)
16        Sec.   10-46.  Private   sector   service;   compensation
17    prohibited.
18        (a)  No person who is employed as the President or  as  a
19    chancellor of Eastern Illinois University may contract for or
20    accept  any  payment  of  money  or  other  thing of value or
21    economic benefit as an honorarium, per diem, salary, or other
22    form of compensation in return for his or her service  as  an
23    officer,  director, trustee, or other member of the governing
24    or executive board of a private, for-profit or not-for-profit
25    association,  foundation,  business  trust,  corporation,  or
26    other business entity located or doing business  in  Illinois
27    or in any other state.
28        (b)  The  President  or chancellor shall not be deemed to
29    have accepted a payment of money or other thing of  value  or
30    economic  benefit  from an entity described in subsection (a)
31    in violation of that subsection if that entity pays  for,  or
32    reimburses  the  President  or  chancellor  who pays for, the

 1    reasonable  travel,  lodging,  and  meal  expenses  that  are
 2    actually  and  necessarily  incurred  by  the  President   or
 3    chancellor  in  order  to  attend  a  regular  meeting of the
 4    governing or executive board of that entity.
 5        (c)  If the President or a chancellor accepts  a  payment
 6    of  money  or  other  thing  of  value or economic benefit in
 7    violation  of  subsection  (a):   (i)  the  same   shall   be
 8    surrendered  by  the  President  or  chancellor  to the State
 9    Treasurer and deposited into  the  General  Revenue  Fund  or
10    otherwise held for the use and benefit of the State; and (ii)
11    the  employment  of  the  President  or  chancellor  shall be
12    terminated by the  board  of  trustees  of  Eastern  Illinois
13    University  unless  the  President  or chancellor establishes
14    good  cause  why  his  or  her  employment  should   not   be
15    terminated.

16        Section  25.   The  Governors  State  University  Law  is
17    amended by adding Section 15-46 as follows:

19        Sec.   15-46.  Private   sector   service;   compensation
20    prohibited.
21        (a)  No  person  who is employed as the President or as a
22    chancellor of Governors State University may contract for  or
23    accept  any  payment  of  money  or  other  thing of value or
24    economic benefit as an honorarium, per diem, salary, or other
25    form of compensation in return for his or her service  as  an
26    officer,  director, trustee, or other member of the governing
27    or executive board of a private, for-profit or not-for-profit
28    association,  foundation,  business  trust,  corporation,  or
29    other business entity located or doing business  in  Illinois
30    or in any other state.
31        (b)  The  President  or chancellor shall not be deemed to
32    have accepted a payment of money or other thing of  value  or

 1    economic  benefit  from an entity described in subsection (a)
 2    in violation of that subsection if that entity pays  for,  or
 3    reimburses  the  President  or  chancellor  who pays for, the
 4    reasonable  travel,  lodging,  and  meal  expenses  that  are
 5    actually  and  necessarily  incurred  by  the  President   or
 6    chancellor  in  order  to  attend  a  regular  meeting of the
 7    governing or executive board of that entity.
 8        (c)  If the President or a chancellor accepts  a  payment
 9    of  money  or  other  thing  of  value or economic benefit in
10    violation  of  subsection  (a):   (i)  the  same   shall   be
11    surrendered  by  the  President  or  chancellor  to the State
12    Treasurer and deposited into  the  General  Revenue  Fund  or
13    otherwise held for the use and benefit of the State; and (ii)
14    the  employment  of  the  President  or  chancellor  shall be
15    terminated by  the  board  of  trustees  of  Governors  State
16    University  unless  the  President  or chancellor establishes
17    good  cause  why  his  or  her  employment  should   not   be
18    terminated.

19        Section 30.  The Illinois State University Law is amended
20    by adding Section 20-46 as follows:

21        (110 ILCS 675/20-46 new)
22        Sec.   20-46.  Private   sector   service;   compensation
23    prohibited.
24        (a)  No  person  who is employed as the President or as a
25    chancellor of Illinois State University may contract  for  or
26    accept  any  payment  of  money  or  other  thing of value or
27    economic benefit as an honorarium, per diem, salary, or other
28    form of compensation in return for his or her service  as  an
29    officer,  director, trustee, or other member of the governing
30    or executive board of a private, for-profit or not-for-profit
31    association,  foundation,  business  trust,  corporation,  or
32    other business entity located or doing business  in  Illinois

 1    or in any other state.
 2        (b)  The  President  or chancellor shall not be deemed to
 3    have accepted a payment of money or other thing of  value  or
 4    economic  benefit  from an entity described in subsection (a)
 5    in violation of that subsection if that entity pays  for,  or
 6    reimburses  the  President  or  chancellor  who pays for, the
 7    reasonable  travel,  lodging,  and  meal  expenses  that  are
 8    actually  and  necessarily  incurred  by  the  President   or
 9    chancellor  in  order  to  attend  a  regular  meeting of the
10    governing or executive board of that entity.
11        (c)  If the President or a chancellor accepts  a  payment
12    of  money  or  other  thing  of  value or economic benefit in
13    violation  of  subsection  (a):   (i)  the  same   shall   be
14    surrendered  by  the  President  or  chancellor  to the State
15    Treasurer and deposited into  the  General  Revenue  Fund  or
16    otherwise held for the use and benefit of the State; and (ii)
17    the  employment  of  the  President  or  chancellor  shall be
18    terminated  by  the  board  of  trustees  of  Illinois  State
19    University unless the  President  or  chancellor  establishes
20    good   cause   why  his  or  her  employment  should  not  be
21    terminated.

22        Section 35.  The Northeastern Illinois University Law  is
23    amended by adding Section 25-46 as follows:

24        (110 ILCS 680/25-46 new)
25        Sec.   25-46.  Private   sector   service;   compensation
26    prohibited.
27        (a)  No  person  who is employed as the President or as a
28    chancellor of Northeastern Illinois University  may  contract
29    for or accept any payment of money or other thing of value or
30    economic benefit as an honorarium, per diem, salary, or other
31    form  of  compensation in return for his or her service as an
32    officer, director, trustee, or other member of the  governing

 1    or executive board of a private, for-profit or not-for-profit
 2    association,  foundation,  business  trust,  corporation,  or
 3    other  business  entity located or doing business in Illinois
 4    or in any other state.
 5        (b)  The President or chancellor shall not be  deemed  to
 6    have  accepted  a payment of money or other thing of value or
 7    economic benefit from an entity described in  subsection  (a)
 8    in  violation  of that subsection if that entity pays for, or
 9    reimburses the President or  chancellor  who  pays  for,  the
10    reasonable  travel,  lodging,  and  meal  expenses  that  are
11    actually   and  necessarily  incurred  by  the  President  or
12    chancellor in order  to  attend  a  regular  meeting  of  the
13    governing or executive board of that entity.
14        (c)  If  the  President or a chancellor accepts a payment
15    of money or other thing  of  value  or  economic  benefit  in
16    violation   of   subsection  (a):   (i)  the  same  shall  be
17    surrendered by the  President  or  chancellor  to  the  State
18    Treasurer  and  deposited  into  the  General Revenue Fund or
19    otherwise held for the use and benefit of the State; and (ii)
20    the employment  of  the  President  or  chancellor  shall  be
21    terminated  by the board of trustees of Northeastern Illinois
22    University unless the  President  or  chancellor  establishes
23    good   cause   why  his  or  her  employment  should  not  be
24    terminated.

25        Section 40.  The  Northern  Illinois  University  Law  is
26    amended by adding Section 30-46 as follows:

29    prohibited.
30        (a)  No  person  who is employed as the President or as a
31    chancellor of Northern Illinois University may  contract  for
32    or  accept  any  payment  of money or other thing of value or

 2    form of compensation in return for his or her service  as  an
 3    officer,  director, trustee, or other member of the governing
 4    or executive board of a private, for-profit or not-for-profit

 6    other business entity located or doing business  in  Illinois
 7    or in any other state.
 8        (b)  The  President  or chancellor shall not be deemed to
 9    have accepted a payment of money or other thing of  value  or
10    economic  benefit  from an entity described in subsection (a)
11    in violation of that subsection if that entity pays  for,  or
12    reimburses  the  President  or  chancellor  who pays for, the
13    reasonable  travel,  lodging,  and  meal  expenses  that  are
14    actually  and  necessarily  incurred  by  the  President   or
15    chancellor  in  order  to  attend  a  regular  meeting of the
16    governing or executive board of that entity.
17        (c)  If the President or a chancellor accepts  a  payment
18    of  money  or  other  thing  of  value or economic benefit in
19    violation  of  subsection  (a):   (i)  the  same   shall   be
20    surrendered  by  the  President  or  chancellor  to the State
21    Treasurer and deposited into  the  General  Revenue  Fund  or
22    otherwise held for the use and benefit of the State; and (ii)
23    the  employment  of  the  President  or  chancellor  shall be
24    terminated by the board  of  trustees  of  Northern  Illinois
25    University    unless  the President or chancellor establishes
26    good  cause  why  his  or  her  employment  should   not   be
27    terminated.

28        Section  45.   The  Western  Illinois  University  Law is
29    amended by adding Section 35-46 as follows:

 2    chancellor of Western Illinois University may contract for or

 4    economic benefit as an honorarium, per diem, salary, or other
 5    form of compensation in return for his or her service  as  an
 6    officer,  director, trustee, or other member of the governing
 7    or executive board of a private, for-profit or not-for-profit
 8    association,  foundation,  business  trust,  corporation,  or
 9    other business entity located or doing business  in  Illinois
10    or in any other state.
11        (b)  The  President  or chancellor shall not be deemed to
12    have accepted a payment of money or other thing of  value  or
13    economic  benefit  from an entity described in subsection (a)
14    in violation of that subsection if that entity pays  for,  or
15    reimburses  the  President  or  chancellor  who pays for, the
16    reasonable  travel,  lodging,  and  meal  expenses  that  are
17    actually  and  necessarily  incurred  by  the  President   or
18    chancellor  in  order  to  attend  a  regular  meeting of the
19    governing or executive board of that entity.
20        (c)  If the President or a chancellor accepts  a  payment
21    of  money  or  other  thing  of  value or economic benefit in
22    violation  of  subsection  (a):   (i)  the  same   shall   be
23    surrendered  by  the  President  or  chancellor  to the State
24    Treasurer and deposited into  the  General  Revenue  Fund  or
25    otherwise held for the use and benefit of the State; and (ii)
26    the  employment  of  the  President  or  chancellor  shall be
27    terminated by the  board  of  trustees  of  Western  Illinois
28    University    unless  the President or chancellor establishes
29    good  cause  why  his  or  her  employment  should   not   be
30    terminated.

31        Section  99.  Effective date.  This Act takes effect upon
32    becoming law.
