92_SB0643 LRB9207934JMmb 1 AN ACT concerning criminal identification information. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Criminal Identification Act is amended by 5 changing Section 3.1 as follows: 6 (20 ILCS 2630/3.1) (from Ch. 38, par. 206-3.1) 7 Sec. 3.1. Criminal History Record Information. 8 (a) The Department may furnish, pursuant to positive 9 identification, records of convictions simultaneously to the 10 Department of Professional Regulation and agencies licensed 11 pursuant to the Private Detective, Private Alarm, Private 12 Security, and Locksmith Act of 1993 for the purpose of 13 meeting registration or licensure requirements under The 14 Private Detective, Private Alarm, and Private Security Act of 15 1983. 16 (b) The Department may furnish, pursuant to positive 17 identification, records of convictions to the Illinois Liquor 18 Control Commission and to policing bodies of this State for 19 the purpose of assisting local liquor control commissioners 20 in carrying out their duty to refuse to issue licenses to 21 persons specified in paragraphs (4), (5) and (6) of Section 22 6-2 of The Liquor Control Act of 1934. 23 (c) The Department shall charge an application fee, 24 based on actual costs, for the dissemination of records 25 pursuant to this Section. Fees received for the 26 dissemination of records pursuant to this Section shall be 27 deposited in the State Police Services Fund. The Department 28 is empowered to establish this fee and to prescribe the form 29 and manner for requesting and furnishing conviction 30 information pursuant to this Section. 31 (d) Any dissemination of any information obtained -2- LRB9207934JMmb 1 pursuant to this Section to any person not specifically 2 authorized hereby to receive or use it for the purpose for 3 which it was disseminated shall constitute a violation of 4 Section 7. 5 (Source: P.A. 85-1440.) 6 Section 99.
