1 AMENDMENT TO SENATE BILL 609
2 AMENDMENT NO. . Amend Senate Bill 609 as follows:
3 on page 1, line 9, by deleting "other adult uses,"; and
4 on page 3, by replacing lines 8 through 18 with the
5 following:
6 "Section 15. Restrictions on locations of adult uses.
7 No adult use shall be located within 1000 feet of any public
8 or private elementary or secondary school, any public park,
9 any place of worship, any pre-school, any day care facility,
10 any mobile home park used for residential purposes, or any
11 area that is zoned as residential.
12 Section 20. Local Standards; Home Rule. The provisions
13 of this Act constitute minimum restrictions on locations of
14 adult uses for all governmental units, including home rule
15 units. Any governmental unit may prescribe more stringent
16 restrictions on the locations of adult uses.
17 A home rule unit may not regulate locations of adult uses
18 in a manner inconsistent with this Act. This Act is a
19 limitation under subsection (i) of Section 6 of Article VII
20 of the Illinois Constitution on the concurrent exercise by
21 home rule units of powers and functions exercised by the
22 State.

1 Section 25. Applicability. This Act shall not apply to
2 any adult use established and having a permanent business
3 location prior to the effective date of this Act.
4 Section 30. Penalty. A violation of any provision of
5 this Act is a separate petty offense for each day of
6 violation.".
