 1        AN ACT concerning guide dogs.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Guide  Dog  Access  Act  is amended by
 5    changing Section 1 as follows:

 6        (720 ILCS 630/1) (from Ch. 38, par. 65-1)
 7        Sec. 1. When a  blind,  hearing  impaired  or  physically
 8    handicapped  person is accompanied by a dog which serves as a
 9    guide or leader for such person or when a trainer of a  guide
10    or  leader  dog  is accompanied by a guide or leader dog or a
11    dog that is at least 6 months old that is being trained to be
12    a guide or leader dog, neither the blind, hearing impaired or
13    physically handicapped person nor the dog shall be denied the
14    right of entry and use of facilities of any public  place  of
15    accommodation  as  defined  in Section 5-101 of the "Illinois
16    Human Rights Act", if such dog is wearing a harness and  such
17    person presents credentials for inspection issued by a school
18    for training guide dogs.
19        Any violation of this Act is a Class C misdemeanor.

21        Section  10.   The  White Cane Law is amended by changing
22    Section 3 as follows:

23        (775 ILCS 30/3) (from Ch. 23, par. 3363)
24        Sec. 3.  The blind, the visually handicapped, the hearing
25    impaired and the otherwise physically disabled have the  same
26    right  as  the  able-bodied  to  the full and free use of the
27    streets, highways,  sidewalks,  walkways,  public  buildings,
28    public facilities and other public places.
29        The blind, the visually handicapped, the hearing impaired

 1    and  the  otherwise  physically disabled are entitled to full
 2    and  equal   accommodations,   advantages,   facilities   and
 3    privileges of all common carriers, airplanes, motor vehicles,
 4    railroad trains, motor buses, street cars, boats or any other
 5    public   conveyances  or  modes  of  transportation,  hotels,
 6    lodging places, places of public accommodation, amusement  or
 7    resort  and  other  places  to  which  the  general public is
 8    invited, subject  only  to  the  conditions  and  limitations
 9    established by law and applicable alike to all persons.
10        Every  totally  or  partially  blind, hearing impaired or
11    otherwise physically disabled person or a trainer of  support
12    dogs,  guide dogs, or hearing dogs shall have the right to be
13    accompanied by a support  dog,  guide  dog,  or  hearing  dog
14    especially trained for the purpose, or a dog that is at least
15    6 months old that is being trained to be a support dog, guide
16    dog,  or  hearing  dog  in  any  of the places listed in this
17    Section without being required to pay an extra charge for the
18    guide, support or hearing dog;  provided  that  he  shall  be
19    liable  for  any damage done to the premises or facilities by
20    such dog.
